Just had a quick riffle through the proposed Code and I can't see (I MAY be having a dense moment) where the period of parking is actually defined, in particular how passing in front of an ANPR camera then spending several minutes driving around to find a space before being able to park. I also can't see how parking is distinguished from leaving a space and then queueing to pass an ANPR camera and exit the carpark.
There's no mention I could find of double dip either. |

Is it proposed? I thought it was agreed.
There is a section pointing out that ANPR on entry is not the same as a period of parking and there is a bit about the operator in their manual checks needing to be careful to avoid double dipping. Basically, it just draws the PPC's attention to the issues of ANPR and double dips and leaves it up to them how to solve those issues. What more do you want? |

'Agreed' being meaningless as it needed no agreement. It is finalised but as it's not yet in force I would suggest 'proposed' is still a valid description.
https://www.gov.uk/government/publications/...ode-of-practice Section 5.1 sets out consideration period and also makes it clear it ends once parking commences and not by driving through the 'in' ANPR gate. 5.2 sets out Grace periods All this is laid out in a table in Annex B, combined MINIMUM consideration and grace periods have a range of 15-20 minutes depending on the car park. It would certainly lunch APCOA's drop off tariffs at LHR! Is it not in force?
There is a transition period for existing arrangements the details of which are not explained. However, doesn't any new arrangement need to comply with it? I haven't seen any statement about what the current state of play is. |

No. It's not totally unreasonable to allow the companies time to change there paperwork and signage and practices to comply with the new code, also the new (truly) Independent Appeals Service needs to be established. end of next year is my best guess, I've not seen a timeline. Of course what is in the code may be persuasive as to what is reasonable should it get to court, and as the code hasn't changed the fundamental (contract law) basis for parking charges I'd be using thinks like the grace periods should I have a case going to court (if they helped). -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

What it says is
"The publication of this Code therefore marks the start of an adjustment period in which parking companies will be expected to follow as many of these new rules as possible. The Code will then come into full force before 2024, when the single appeals service is expected to be in operation." I still think that means that for new agreements they need to follow the code, for example, new signs shouldn't be including extra debt collection charges. As this thread wasn't updated, the Code is currently subject to a judicial review and has been withdrawn from 7th June pending the outcome.
