Hi,
Thanks for this forum and thanks to everyone who really helps out here. You guys are heroes! So we have received 2x PCNs for Moving Traffic Contravention. The driver was unfamiliar with the area and had accidentally driven in and out of so marked 'Bus Gates'. With the entry and exit within 18 minutes of each other and a PCN issued for the entry and the exit! I agree that the contraventions occurred, but are multiple PCNs really allowed for the same contravention? I mean its the contravention on the same signs on the same day within minutes of each other. Do we have any chance of winning an appeal here? I reviewed similar cases for the same hospital road: http://forums.pepipoo.com/index.php?showto...121566&st=0, http://forums.pepipoo.com/lofiversion/inde.../t118709-0.html, Only this case seems that there might be something that can be appealed against, but I am not sure if the OP on that thread followed through and whether an appeal was won? http://forums.pepipoo.com/index.php?showtopic=125154 PCNs uploaded here: PCN-1-page-1: https://ibb.co/x2HZRj0 PCN-1-page-2: https://ibb.co/YpcDFJd PCN-1-page-3: https://ibb.co/rbn0nbP PCN-2-page-1: https://ibb.co/ypn80Kc PCN-2-page-2: https://ibb.co/86MttWc PCN-2-page-3: https://ibb.co/rbn0nbP Any advice? Mike
You can submit to the tribunal any time before the hearing so I would send this by e mail make sure yo add the case number . If you have the envelope and it is post marked send a copy to show date of posting, but only if it helps I:e the posted it after the 2nd.(post a copy here first so we can check) In response to the council case summary recieved by myself on Saturday the 10th of August I would like to draw the attention of the adjudicator to some inaccuracies within this summary. The council refer to s4(8) of the regulations. This regulation has nothing to do with the making of representations This is regulated within schedule 1 as per my appeal. The same applies to the service of a CC. 4(8)(v) only describes a period. What that period is, is set in schedule 1 It should further be noted that the council have nothing to say on limbs 3,4 and 5 of my appeal -------------------- All advice is given freely. PCNs often have a version number, something like "Moving Traffic PCN March 2019" or similar wording printed in one of the corners, if you could find the identification number on your PCN and let us know that would be very useful (it looks like the corners are cut-off in the copy you posted).
