NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - April 2018 Date of the NIP: - 8 days after the offence Date you received the NIP: - 9 days after the offence Location of offence (exact location as it appears on the NIP: important): - Buckingham Avenue Slough Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - First If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - I was driving home from local Wickes carrying 16 top soil bags (300-400kg) in the car boot hence driving slower than normal. Had to miss couple of green lights as could not speed up. There is fixed camera on this stretch but NIP states doing 38mph in 30 zone and manned equipment. Very much annoyed for being caught on a day when driving slowly and with care. Also annoying is that no evidence has been provided and will not be provided until I decide to go to court and miss the chance of SAC. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes Were you driving? - Yes Which country did the alleged offence take place in? - England - England NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered: Generated by the PePiPoo NIP Wizard v3.3.2: Sun, 29 Apr 2018 16:57:18 +0000 |

Perfectly normal not to provide any evidence, the reward you get for not making waves and costing them money is the course or the reduced penalty via the fixed penalty offer.
You can always request a copy of photos to help confirm the drivers ID or similar. If you think you were probably speeding then not sure how looking at their evidence would help? -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

What help do you want?
Either accept the SAC or the matter will go to court, which without a defence, will prove to be an expensive day out. -------------------- |

Thanks guys for a fast response.
This road has 3 traffic lights, 1 fixed camera and a mini roundabout. I can remember going slowly through these even slowing couple of cars behind me. There is not much length between these to gain much speed. Pretty confident that I didn’t sped up on this journey but can’t be 100%. Not sure what evidence I can use other than Wickes receipt showing bags purchased 10 minutes before the said event. I don’t know what evidence police can produce when using manned equipment and how reliable it is. Part of me says to challenge it and go to court but not sure if there is any chance getting a decision in my favour. I guess I am trying to get over my annoyance before accepting the reality. |

Not sure what evidence I can use other than Wickes receipt showing bags purchased 10 minutes before the said event. That's got to be the most creative 'defence' I've seen in a while... Unless it's physically impossible to reach 38mph then it's a non-starter. I don’t know what evidence police can produce when using manned equipment and how reliable it is. Part of me says to challenge it and go to court but not sure if there is any chance getting a decision in my favour. Camera appears to be this Gatso. Although, using a manned camera near fixed cameras is sometimes used for those that speed up between them if they are aware. There's little reason to doubt the accuracy. Asking for the photos, as above, is worth trying. They often supply both photos to perform a manual calculation of the speed if it was the Gatso. Taking the SAC is probably the pragmatic thing to do unless there is an obvious error. Challenging is potentially very expensive - a bill nearer £1k would likely result in a contested trial. Ask for a copy of any available photographs to assist in identifying the driver, do not mention evidence. Most forces will supply these and they may well be those that show your speed. Note that this does not extend the time you have to identify the driver, do not risk exceeding that.

Thanks for all the advice. NIP mentions manned equipment so I guess it was a van mounted device. I will ask for the photos and send the S172 in time.
Hopefully SAC will be offered and the 3 year clock has started for me |

Hi All
I thought to update you on my request for assistance in identifying the driver. Thames police has sent a photo showing my car in front and another one behind with both the registration numbers clearly visible. It looks like taken from road level so most probably vehicle based camera. On the top left, along with date and time there are numbers 00:32:35:03. Not sure what these mean. The driver is not visible due to lowered sun visor and sunlight angle. If it is allowed and helpful I can upload the scan of the photo. Best regards. |

I have a curiosity question.
Even if the bags were the lowest estimated weight of 300kg and there were 16 of them, that's 4800kg. That equates to around 4.7 imperial tonnes. Would the car (it does say car boot) not be overloaded? Are you sure those weights are correct? |

300 is quite clealry the estimated total weight, not many people could lift a 300kg bag could they? So Wickes wouldn’t sell them that weight.
