Hi Guys
One of my friend got one of the letter through the post for Failed Red Green Arrow/ lane closure traffic light signal.

He has to pay £100.00 and 3 penalty points on his licence.

Is there anything he can do to appeal ?

Your replies and advice will be appreciated.

Dunno.

What are the details behind the allegation? Presumably a motorway offence?

Did your friend drive down a lane marked with a red x?

Those images you have posted are the both same side of the NIP, except one is redacted while the other has your friends name & address on it still. Can you post the front image so it gives a bit more detail / location?

He cannot appeal as such, what he can do is reject this fixed penalty and ask for the allegation to be heard in court. Then it is up to the prosecution to prove he committed the offence which appears to be ignoring the lane closure sign on a motorway. If they cannot convince the court that he committed the offence, then he is clear and gets no points and pays nothing. If they do convince the court he committed the offence then he will still get the 3 points but have to pay very much more than £100 in the form of a fine related to his income, plus costs.

Given that the offence may well have been picked up by a camera, if there is a picture of his car committing the offence, the court will be unlikely to acquit him. The effect is, if he really believes he did not commit the offence he should go to court, if he did commit it or is not sure, accepting the fixed penalty is likely to be the least painful way forward.

Thank you guys for your replies.

Offence code is RT88971.

It was on the local road in the city Watling street Road,Preston, on 25/08/2019 at 22:00hrs.

Just spoke to him and he said he stopped at red light and by mistake his car rolled over the White line going across the signal and the police car was either behind or one of the side road , so pulled him over and issued a ticket, but he had no intention of going through the red light, but I think going off his conversation he lost his concentration at the time.

I will see what you guys say and just tell him to go with either option 1 or option 2

The offence is complete is any part of the car moves over the stop line during red. Whether there was intention to go through or not is irrelevant but if he simply crept over the line it seems particularly harsh to pursue...

How far over did he creep? Was there an advanced stop line (aka cycle box) at the junction?

He was on Watling street road and I don’t know what he was thinking or what was going through his mind, he just turned left from the traffic lights without realising it was red and the police car was behind him.

So I told him I don’t think you got leg to stand on and plus the police car may have camera , which may have been recorded and I don’t know how many police officers were there.

If only we had turn left on red in the UK or all round flashing amber traffic signals outside normal hours many junctions would be less congested.

With all our pedestrians (most of them looking at their phones), and the likelihood that our drivers would regard flashing amber as meaning "go for it!", our junctions would probably be very congested - mainly with emergency service vehicles.
