Hi,
I recently travelled from Jersey (Channel islands) to London in my car for a business trip. On 11 June and 13 June 2019, I drove my car through central London at 18:26 and 18:14 respectively (I waited until after the Congestion charge). I received two PCNs for £160 each (£80 if paid before 14 days). I was completely unaware of the new ULEZ regulation and I did not see any sign whatsoever. And even if I had seen it, I would have know what it meat to be honest... I filed a representation online but it only gave me the possibility to tick on the "I was not aware about ULEZ regulations" without the possibility of explaining that my car is a foreign car and that I was unaware of this regulation. I just received a rejection notice from a company called EPC Plc which I think is in charge of dealing with foreign cars representations. I would like to appeal but by reading the forums, it seems very difficult to get a positive outcome based on the fact that signs are not explicit and the new regulation was not advertised in Jersey as far as I am aware. My car is EURO 6 but it seems that foreign cars need to be manually registered by EPC Plc. Which by the way I hace already done even though TfL's website has not received this info from EPC Plc yet.. but that is another story I am dealing with... My question here is: Is there any chance an appeal could work for me? I am happy to go to London for a hearing. Alternatively, can I apply at least for an extended discount? (£80) which has now passed...? TfL say that their objective is compliance and not revenue maximisation which is clearly my case as I am now compliant having registered my car with EPC Plc so I don't see why they would not at least accept a discounted payment... if not cancel the PCN on the grounds explained above. Any help please? Your car is exempt so they are attempting to extract penalties from you for not registering.
Did you say your car is exempt in your appeal? I'm suspicious of EPC handling this - they are debt collectors and the letter you have looks like a template rejection. But you have been offered access to the tribunal which you must do to freeze the penalty at £160 - they have not offered the discount I see. You must appeal to the tribunal within the 28 day period or the cost will go up to £240 each, There has been some success when the car is compliant but not registered
get a screenshot of the registration page of EPC of better yet confirmation that you registered with them dependent on what you have your appeal can be drafted -------------------- All advice is given freely. It is given without guarantee and responsibility for its use rests with the user
