I was driving on the 28 and was stopped by the police for an offence I didn’t committed. I was told by the officer that I’m doing 70mph while I was on 54mph tbh.

I asked for evidence on the spot he did he can’t provide me on evidence because he got me on camera and he can’t tamper with the camsre. But if I feel like challenging it at the court he will be in the court to testify against me.

Few days later I got a letter on my door says I was stop while during and exceeding 50mph. Can someone advise me please as I have never had myself in this terrible situation before.

I seriously need the need.

Thanks

The offence is exceeding the limit. Which you admit to doing. So difficult to plead not guilty.

You could request a Newton hearing at court. Where the court will come to a decision on the speed you were doing. But even if you're found to be speeding at the lesser speed, it'll cost you more than the £100 CoFP.

I suggest you accept the CoFP.

Can I send a letter to requested for the evidence still and also this was my first speeding offence and was thinking I will be given option to do speed awareness course rather than asking me to pay the fine and 3 points on my license.

You can ask for what you like, but you're unlikely to get any evidence until you decline the CoFP and elect for court.

You were not offered a SAC due to the speed the cop has recorded.

As you admit speeding, accepting the CoFP would be the pragmatic thing to do, if you go to court and convince the court you were doing the lower speed the punishment will still be worse than the CoFP and if you don’t succeed it will be a lot worse.

Possibly he got you at a greater distance than you thought, but anyway going to court over it is a huge gamble that is unlikely to be successful, accepting the fixed penalty is the pragmatic thing to do in the circumstances, even if you feel it is unjust. It may help to consider times you have exceeded the limit and not been caught!
