Hi all
i really need help im new to this and received a letter from TNC services dated 12th October but delivered to my door on 22nd of October stating protection of freedoms act that driver of vehicle needs to pay in full. This came as a shock as i didn’t have a ticket on my vehicle. Unbeknown to me TNC is a debt collecting services i went onto parking website to appeal however PCN not on their system i wrote them a letter a copy of it below is You issued me with a parking ticket on 29/08/18 but I believe it was unfairly, unlawfully illegally issued. If asked I decline your invitation to name the driver, which is not required of me as the keeper of the vehicle. I will not be paying your demand for payment for the following reasons: • The charge is disproportionate and not a genuine pre-estimate of loss The amount you have charged is not based upon any genuine pre-estimate of loss to your company or the landowner. In my case, the £125 charge you are asking for far exceeds the cost to the landowner I therefore feel the amount you are asking for is excessive. • The notice to keeper is incorrect The Notice to Keeper failed to meet the obligations of Schedule 4 of the POFA Act 2012. E.g. if the Notice to Keeper arrived late after 15 days following the alleged parking office, offence stated it happened on 29 Aug 18 notice to keeper came on 12th of October 18. • P4parking UK did not have PCN on the system for appeals process or payment options and thus the company isn’t aware of this fine, video recording of website can be shown, also the letter issues by TNC parking services does not include a statement discount payment if paid with 14 days which is the rules. If you choose to pursue me please be aware that I will not enter into any correspondence and this will be the only letter you will receive from me until you answer the specific points raised in my letter. As you can see they didn’t have it on their system but as soon as i sent them this letter it magically appear on there and then a few days later taken down again. They responded back with their usual garbage. They also sent me pictures witha ticket on it The pictures of my car show the handheld camera date and time stamp as 10:24:50 seconds yet the ticket on their letter is 10:25:29 seconds, i know it’s a matter of seconds but how can the ticket be on the car before the alleged offence happen still this looks dodgy to me This post has been edited by sgtb: Mon, 12 Nov 2018 - 17:12 |

Yikes. You found possibly the worst letter to send.
Noone is going to read that wall of text. I gave up. Summarise, please, as quite frnakly most of hte narrative has no purpose. |

Apologies like I said first time I’ve supposedly got a ticket. They stated a ticket issued to car but didn’t have on The vehicle.time of the ticket is different on the hand held camera as I don’t have a physical ticket I can’t check what time they issued it but camera time is diffent to what their letter stated it was.

Thanks for that 🤓 as for the timings of the ticket where does that stand You'd definitely get a gold star for noticing that. Is it a slam-dunk claim killer? No. In respect of the timing, all the PPC has to prove is that it is "more likely than not" that the vehicle was parked in violation of the alleged parking contract at the relevant time. That's not a particularly high bar from an evidentiary perspective, and you may have already confirmed it in your written statements. --Churchmouse |

😔I was hoping that would have dealt with it as a camera is no different then a camera on a pole and if timings off for that how can they prove otherwise
Another point p4parking didn’t have ticket on system and only showed up for few days when appeal letter was posted to them and then subsequently removed again what can be said about that |

Are you at POPLA stage then with a live POPLA code?
Why not simply copy a decent P4Parking POPLA appeal, like I just explained in words of one syllable to this poster who finds reading the MSE NEWBIES thread and copying the template POPLA wording, too much for them: http://forums.pepipoo.com/index.php?showto...40&start=40 I've explained what to Google and shown an example P4Parking POPLA appeal there as they seemed about to burst into tears, yet it is as simple as copying one... |

Boom boom popla comes back today saying p4parking isn’t contesting my appeal so thank you very much for pepipoo for having forums like this and fight all these rouge tickets
