Parking Eye Charge that mentions Freedoms Act

Date of event; 15/06/2018
Date Issued; 20/06//2018

Over two hours in a Aldi car Park.

Normally I get off paying these are they dont mention the freedom act on the back - I normally quote; , 9 (2) (f), failing to give the keeper notice of possible liability.

However this one has the following on the back;

Protection of Freedom Act

You are notified under paragraph 9 (2) (b) of schedule 4 of the protection of freedoms act 2012 that the driver of the motor vehicle is required to pay this parking charge in full. As we do not know the drivers name or current postal adress, if you were not the driver at the time, you should tell us the name and current postal address of the driver and pass this notice to them.

You are warned if, after 29 days from the date given (which is presumend to be the second working date after the Date Issued), the parking change has not been paid in full and we do not know the name and address pf the driver, we have the right to recover any unpaid part of the charge from you. This is subjet to our complying with the applicable conditions under Schedule 4 of that Act.

Do you think I can still get away without paying this or as theyve mentioned freedom act then I wont be able to?

PE are better than most at getting it right, though your copy of the letter is not compliant.

Best bet is contact Aldi and complain, if you were actually an Aldi customer.

They don't have permission to sue Aldi 'customers'?

Aldi use the parking eye for their car park, where you have to input your reg onto the computer, however you only get two hours free - I over stayed this.

So you think I cant dispute this as they've mentioned the Freedom Act? If so, I'll try speak to Aldi as I was a customer just lost track of time.

How does anyone spend more than 2 hours in an Aldi ?

I've never spent more than forty minutes in Tesco where you can choose from eighteen varieties of salt

I think the vast majority come to this site and ask what can be said to these companies that will make them cancel the ticket. The truth is often nothing - they are not in the business of accepting appeals. Upholding an appeal when they don't need to isn't going to pay the bills.

It's often a game of nerves which ultimately would have to be at court. Here, I believe they'll reject anything and send lots of letters. Whether they issue a claim is uncertain but we don't believe Aldi have bestowed them unilateral decisions to sue 'customers'. (Which isn't good business for Aldi as sued customers tend to shop elsewhere afterwards)

But, put simply, what's to dispute? The signs say 2 hours, the vehicle exceeded that stay. That's the mandate they have to collect income.
