Parking Charge-failure to park within designated bay(advice needed!)

Hi all,

The driver recently parked in parking in Bershire
The parking charge received was IPC member

When the driver arrived there,the carpark was not full.Unfortunately,the driver had chosen to park beside a big SUV which has exceeded its parking lot on the front right.
So similarly,the driver parked a little to the right on my front.

After paying GBP8 for 3 hours (expensive parking!),the driver returned before the timing and was surprised to see the PCN-charge being parking outside of designated bay.

The driver was really fuming to see that he was penalised for just exceeding the lot by a few inches.The car 2 lots from the driver parked half way across the lot ,rendering it impossible for another car to come in.
But the driver quickly snapped pictures of other cars within the carpark that had parked outside the bay and no PCN

Question: The driver know the board's terms and conditions state that we cannot park outside the lot but the driver exceeded only a little to accommodate the massive car that was parked to the left.Does the driver have a case?
The parking fine is GBP100 and would be reduced to 60 quid if the driver pay within 14 days(usual trick).
Please advise what the driver should do??

Refer to the driver only. For example, "The driver recently parked...", When the driver arrived...", and so on throughout.

It's not a fine.

Where have you been for six weeks?

Have you now received a Notice to Keeper in the post?

Which parking firm is it, I can see the sign has an IPC logo which tells us no appeal would have worked anyway. I also noticed that the useless sign talks about a PCN but doesn't state the £sum - nothing about £100 on that part of the sign you showed us! Therefore no contract agreed to pay £100.
