NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - July 2018 Date of the NIP: - 8 days after the offence Date you received the NIP: - 12 days after the offence Location of offence (exact location as it appears on the NIP: important): - A14 West Bound Carriageway, Stow-***-Quay, Cambridgshire, United Kingdom Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - Not known If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - It is likely that I was speeding. My wifes father was very ill and lives in Cornwall, and I had been rather pre-occupied with his health and the effect it was having on my wife. The NIP arraived through our letterbox, despite being incorrectly addressed. I have just checked the V5 for the vehicle concerned and find that there is a digit missing from the address. I had not previously noticed this. The 28 days is up on Friday. I was tempted to return the NIP saying 'not known at this address' until checking V5 address. I have had previous NIPs with the same vehicle but perhaps didn't check address. What to do now? What to do now? Return the S172 request for driver's details naming yourself as driver. +1. Your only realistic choice. And get your V5C corrected. -------------------- |

Thanks all. I have sent back the NIP with my details corrected and will get my V5 corrected. Is there chance of a fine for not having done so previously?
This may be a new topic, but I understand that now they fine a proportion of your salary. I was driving a van at apparently 81 on a dual carriageway, so in a 60 mph limit. I am self employed and don't have a salary per se. How will this work? |

You are very unlikely to be prosecuted for failing to update your details, it is an offence but very rarely pursued and you will have corrected the record. It is only if you go to court that you meet income related fines, at 81 in a 60 limit you are just within the range for a fixed penalty of £100 + 3 points. The reporting over the adjustment of magistrates' guidance was universally appalling and has confused endless people. Having the wrong details on the V5C is only really prosecuted if it's obvious you've registered the wrong details on purpose, thinking you could get away with traffic offences as a result.
