Hey all, first time on here but maybe you can help.
got a 2nd and 3rd speeding fine on the same road. It's a motorway (m32) in bristol. First ticket 57 in 40, second 47 in 40. Average speed cameras. I googled it and it appears the road is usually 60mph however because the central barrier is broken it's been reduced to 40 for a year or so. It's in the news a lot I think it has caught almost everyone out. My mates a cop and he said he's been caught on it. I've physically tried to go 40 on there and people tailgate you and aggressively overtake. What's worse is it's really confusing where it ends if you're not paying attention to the sky and see the beginning and end yellow Average speed cameras as the 40 signs are drowned out with other signs and some are really small. Now I really don't want to lose my license, so what do I do? Do i bring up the confusing speed limit? Do I mention that it's difficult to go 40 on that road? Both tickets were at midnight when it's dead and i'd just come to this section from the rest of this 60mph motorway. Any advice, and mitigation ideas would be great (I run a clothing printers and I use the car to drop our orders off to DPD every evening) - I've got about 10-12 days to reply yet. thanks. |

The only possibility of a defence that I can see is the one mdann52 suggested : The remote possibility that the speed limit is invalid because the Traffic Regulation Order hasn't been converted into a permanent Order Would need to know the date and which part of the M32 - some where effective from January 2018 - here. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Thanks all.
In reply to the above, they were in late March, and they were between the 2 sets of average speed cameras towards the bristol end. If I were to challenge this speed restriction then would I be able to do this myself or would I need to pay for representation. thanks. |

You could do it yourself, its a simple exercise to require them to produce the order that created the lower limit, if the order is good, guilty, if not you should walk.....

This covers the section in question, looks like this is not an avenue worth looking into as that TRO covers the relevant area, given those are the only SPECs cameras on that stretch - think they were turned on early March from memory. For anyone interested, the cameras are now on google maps (start + end). I haven't measured the exact distances, but it looks about right. Also, the 40 signs start here, which does seem to be well before the TRO takes affect here, however this is likely immeterial of caught by the SPECs. I've only glanced at it but the document you cite seems to be dated 2017 and the survey quoting average speeds was undertaken in January 2015. The document is a consultation paper, the recommendations of which are to extend the bus lane on that stretch. This entails the narrowing of other lanes and the accompanying recommendation is that a permanent 40mph limit be imposed mainly due to the reduction in lane widths.
