PCN Code 21 Suspended Parking

Hi all,

I was hoping you could help me with a PCN I was issued with this morning. I parked on my last night (Permit Parking bays) and didn't notice any parking suspension signs (I wasn't particularly looking either). Then this morning at 7:45am I get to my car and there is a ticket on it (issued a few minutes before) and I notice the parking suspension signs on a lamp post a few meters away from my car

Let me know if there is anything I can do to appeal this please

My current list is below, please let me know if there are any other reasons or if any of the below is invalid

Parked far away from sign (at least 5m)
References street numbers can’t be read at night
Dark at night when got there so didn’t notice signs
Many other cars where there when parked so clearly also didn’t notice signage
Right on end of suspended numbers
Regularly park there so don’t have to look for a traffic sign each fine you park (and wasn’t notified of the suspension by leaflet or email)
No start and end times on sign

No engineering work was taking place nor had taken place at the tone of contravention, therefore the reason for suspension at that time did not exist

Didn’t notice, when did sign go up and log of cars in bay at the time

No cones around bays and not clearly defined

Not dft approved suspended bay sign design for Brent Council; Road traffic act 1984 sections 64 and 65

Sign not outside suspended parking bays

Unclear where sign is in relation to my vehicle

Right, so unfortunately most of your list is without merit, see below::

Regularly park there so don’t have to look for a traffic sign each fine you park (and wasn’t notified of the suspension by leaflet or email) - very wrong, you are expected to check the sign each time, there is no duty on the council to draw your attention to changes in the restrictions by leaflet or email, they just need to install signs next to the bay

No engineering work was taking place nor had taken place at the tone of contravention, therefore the reason for suspension at that time did not exist - mostly irrelevant unless you can prove the works had been completed already


The only thing I can think might have some mileage in it is the issue of house numbering not being visible in the dark. Motorists are under a duty to check signage, they are not under a duty to creepily walk into adjacent driveways with a torch looking for the house numbers. I would suggest you take a photo at around the same time as when you parked and post it on here so we can evaluate the strength of your case.

This is a picture of the houses I parked outside

Also, the utilities work has still not been started; so is there a case that the reason for suspension was invalid as it didn’t need to be suspended that early

Furthermore is it a valid point that from the photos supplied I can not ascertain where my car was (in relation to parking bays) nor can it be said where it is in relation to the sign?
