Newbie! Any guidance, advice etc. which you may be able to provide would be greatly appreciated; Thank you in advance The story so far... The three attached PCNs from London Borough of Croydon (LBC) have been received, two alleged contraventions occurring within a 10 minute time window, another with 72 hours of the first (Newbie thought: number of offences within short space of time). Not being from the area, I am not familiar with the road layout and any restrictions that may apply in the area. I was collecting some friends from a Birthday night out, who similarly were not familiar with the area. The location was described by those being collected as a safe and quiet place to be collected - and when I approached, not only did I not see the signage which I have since examined via Google Maps (Attached also), I saw there were a number of vehicles parked down this road, facing the same direction as my approach, and therefore I deemed this a reasonable location to enter - especially at the time of the alleged offence - shortly after 3am. After an unsuccessful 'extraction' of the aforementioned friends, I'd exited the road to reassess, and received phone calls from the friend being collected stating they were definitely at the designated Surrey Street collection Point (I can provide evidence of the times of these phone calls if required). This obviously led to the subsequent alleged offence 9 minutes later - successful extraction and I proceeded home. With some, now very clearly flawed, knowledge of the area, when my party goers wished to return to the area for some food and drink a couple of days later, I used this "knowledge" of a safe and quiet location to carry out a Drop-Off this time, leading to alleged offence number 3. Looking through the website, all similar offences appear to be dated, and based on historical signage, so it appears that defence is shot. Are there grounds for offence occurrence within a time period? At the first alleged offence, there is another vehicle clearly using the road against the restriction - any support there? I also notice the letter states "London Local Authorities and Transport for London Act 2003 - Understanding this has now been revised to the new Local Authorities and Transport for London Act 2008 - Support? Possible mild emergency state of vulnerable persons in unknown area defence for alleged offences 1 and 2? Understanding you'll be looking for the video files for these offences, I will be requesting these tomorrow from the relevant authorities and will post here in a timely fashion once received. Any information further required, please let me know, and I'll attach as required - Otherwise any guidance or advice you can provide will be greatly appreciated! I have to say nothing you say sounds like a valid basis of appeal. Basically you either didn't see the signs or you didn't know what they meant, the fact that you saw other vehicles there and "deemed it" to be a reasonable location to enter is neither here nor there.
Let's wait to see the videos, but at this point discretion is all you have to go on. There's an argument to be made on the continuous contravention ground, but I'm not aware of this being used for a pedestrian zone contravention before.
