Hi everyone,
Hope everyone is healthy and well. I'm looking for advice to stop bailiff from returning and incurring charges from them. I have bailiff 1st time visited when I wasn't at home on Thursday 24 May 18 and he drop the notice of enforcement notice with: - bailiff ref no. - PCN no. - £408 fine ( no break down of the fine ) I called on Friday to Swindon Council and found out that I was driving in bus lane in 27 Dec 2017. Swindon Council told me the case has forwarded to TEC, so I call TEC and they asked me to fill the PE3 & PE2 forms to send it back to TEC. I moved home just before that date and have the address changed in 15 Jan 18 and V5C log dated 01 Feb 18. I have filled in, sworn and emailed the PE3 and PE3 forms to TEC on Tuesday evening 29 May 18. I'm OK to pay my fine or late payment to the council/tec, but not £400 with bailiff visiting. It's been almost 2 days since I sent the PE3 & PE2 form to TEC. Could you please advice what I can do to stop the bailiff to return as they put on extra charges each time they visit or dropping off a letter. believe some of the drivers have this unfortunate experience. What do you do in the end? Do you end up paying reduce fine or paying what the bailiffs asked for? How long do I have to wait for TEC to reply before I call? should I copy the Swindon text to the bottom of the email? or should I forward the email that I sent to Swindon Council? |

But it helps if you had said; then we understand why you don't quite get what is going on sometimes. And, in our posts, can try not to use more unusual words. -- So, all sent? The point is, that you have a fairly good case but if the Council object TEC are very likely to refuse your application. Then you would have to pay £100 for a full Judge to decide. We want to avoid that expense. -------------------- |

Yes, all sent. Also got reply from parking@swindon.gov.uk with message below: “This appeal will be investigate and you will receive a responcse from Representation Officer with 10 working days.” Well, fingers crossed :-) |

and you sent a copy to TEC? Yes, i've sent a copy to TEC and I've got a letter response from Swindon Borough Council. Below are the message in the letter: [ Thank you for your recent correspondence. I can confirm we will be accepting your Late Statutory Declaration, this is due to there being a cross over in the time the Penalty Charge Notice was issued and you changing your V5C log book. We must wait for the Traffic Enforcement Centres decision, and once accepted a Penalty Charge Notice will be issued to your new address. ] Should I scan and email the letter to TEC or should I just wait? Haha! Nice message.
You can just wait or send TEC a copy if it makes you feel happy. But my experience is that they are useless of taking note of anything once your OOT is in processing. TEC are not allowed to make the decision for 14 days, so another week yet. -- Assuming TEC will now accept your OOT, do you understand what happens next? -------------------- |

I have received reply from TEC regarding the 2nd email, which include the message that I sent to Swindon Borough Council. Below is the reply from TEC: =========== Good Afternoon Thank you for your email. The Traffic Enforcement Centre is unable to accept any additional evidence after an out of time application has been processed. You may want to contact the local authority concerned. Paul Smith Administration Officer | HMCTS | Traffic Enforcement Centre | 21-27 St. Katherines House | Northampton | NN1 2LH Phone: 0300 123 1059/ 619450 =========== I will call TEC to ask about the application status today, hopefully they will give me the good news. |

I managed to call TEC just now. They said my application is being processed, the TEC is communicating with Swindon Borough Council. And they confirmed the Bailiff is on hold during the TEC is processing my application. At least I'm not worry that someone will clamp my car for now.

Good evening Neil B & everyone.
Back from work about 7pm, check mail box and found another bailiff notice. Same company and content as previous one, just different bailiff that came before 2pm. I called TEC last month, and they told me the bailiff will be on hold if my application is being processed. Does that mean my application just on the pile of file? I’m confused. I’ll give a call to TEC tomorrow. Should I hide my car somewhere safe for now? Thanks. |
