Driver was unaware they had entered the congestion charge zone, nonetheless as it was a Sunday they thought that there would be no charge to pay and did not know that new operating hours were in place.
PCN shows driver exiting via Bath Street on 9 August. Having viewed images on google maps I am unable to find anything that resembles an zone end sign or warning to pay. They suspect they entered via Dingley Road and, again having viewed google maps, there are signs indicating entrance to the congestion charge zone, however they are labeled Mon - Fri 7 am - 6 pm. I am unsure whether this has been updated given the change in operating hours. Are there grounds for appeal on the basis that the exit has not been adequately signed? From my understanding when they changes were first brought in TFL allowed a grace period, and we are now past that, however due to the lock down it had been months since the driver had been anywhere near the congestion charge zone and all they had to go on was knowledge from the past years that there is no congestion charge on the weekend. They feel like there was not sufficient broadcasting of the changes, and had they been aware they would have taken measures to avoid congestion charge zone or ensured charge was paid. Given current circumstances £80 is a large hit to take and substantially more than the £15 charge, which may have been avoided if exits were clearly labeled and the changes been sufficiently advertised. The entry signs have been updated of course although it is possible they missed one but unlikely.
It's very hard to contest the CC. We can check the PCN. |

OP, can we please know who's who here.
We don't need 'the driver'. Was it you? If not, then you cannot know what the driver thought/did etc. And as explained, the contravention occurs if a vehicle is on a road in the zone during the charging period and fails to pay the charge in a timely manner. Exit signs (not that you would know, or do you) are irrelevant. Let's no go through 'was there a sign' at the entrance, it would be a dead-end. On the basis of what we know, pay the discount and move on. However painful financially this might seem, it's less painful than submitting reps, possibly losing the discount and messing about with post-rejection paperwork thereby risking even higher charges. |

While all hope may appear to be lost, I think that if you or your driver are regular entrants into the CC, and paid on the old days/times basis, some reps should be submitted on those lines - regular user, but Covid19 lockdown meant your visits into the zone had only recently recommenced. Apologies for not knowing about the new days and times etc. Whilst I doubt they will give way, TfL being virtually bankrupt, it's always worth having a go. That's my opinion, anyway.
Businesses inside the CC are already complaining bitterly about the weekend and evening restrictions. |

I too didn't realise TFL had extended to the weekends. I challenged both tickets just advising them I didn't realise they had included the weekends and got a letter today advising they had cancelled both PCN's which where £80 each. |

I challenged both tickets just advising them I didn't realise they had included the weekends and got a letter today advising they had cancelled both PCN's which where £80 each. This verges on the unbelievable given what's been posted repeatedly about TfL in recent months. |
