PCN -Contravention Code 01 - Parking on double yellow lines 7.23am, Tower Lamlets- CPZ

Hi all

Got a pcn on the windscreen for parking on a DYL at 7.23am. The car is always parked there in the evenings atleast 4 days a week till 8.30am ( then occasionally a Blue badge is used till 9.30am or 10 am if still parked there). Probably have been lucky as after reading other posts it seems BYL are 24/7 no parkings allowed so probably going to get gunned here. However been parking here after 5.30pm till 8.30am and many other cars for the past 5-6 years.

Not sure where I stand with this. Any reason to appeal ? confused with the CPZ times thought it was okay as never had a ticket here before and many people park here after 5.30pm in the evening without getting a ticket ( I know this doesn't make it okay to park there )

As you are aware double yellow lines mean no waiting at any time so you can forget the controlled zone times.

Its seems that there was only a single yellow there as recently as 2017:

Think you have been lucky up to now for past 2 years. As you are also no doubt aware you can park on yellow lines (with no loading restrictions and in most London boroughs) for 3 hours with a blue badge.

You can try asking for discretion based on expectation of parking there past the change from single to double yellow. But don't park there again without a blue badge.

I find it hard to believe you don't know the meaning of double-yellow lines, and really am astonished that you have managed to park on these for so long without getting a PCN. You are absolutely and totally bang-to-rights on this. Double-yellow lines apply 24x7 and mean No Waiting, (aka parking), I can't see any possible appeal from what you have told us so far, except if the PCN itself contains fatal errors of content, and even then you'd have to risk the full PCN penalty at London Tribunals for a final decision, the council will never give way.

It seems that you've been blatantly ignoring the regulations for some time, and, if the BB isn't yours or belongs to someone who lives at the address you're parked outside of, also committing fraud.

Of course you can park on SYLs and DYLs but the time allowed is 3 hours. You've been lucky if you didn't get PCNs in the past, and could argue "legitimate expectation", but it is almost inevitable you'd have to take this to London Tribunals and risk the full penalty, the discount option has gone by the time you get to LT.
