Hi there

I'm brand new to this forum & I'm hoping to have some much needed help please.

My car had a Parking Charge Notice from the above company on 14/09/2019.

I filled in their online form to appeal the ticket explaining that their signs were not visable enough.

They have replied stating that they need to know the details of the driver before they can consider my appeal.

I have attached the ticket for you to see. Any help would be greatly appreciated.

Thank you

Shame you sent in that appeal so early. The usual recommendation is to appeal as late as possible

There is no requirement to identify the driver so just sit and wait and see what they send next. For POFA purposes that NTD would appear to be deficient.

The aim is to get them to talk to you as the keeper but forget to issue a notice to keeper within the required period of 56 days or forget to contact the DVLA .

I panicked when I realised the 14 days were coming up so thought I'd better respond sad.gif

Thank you for that Ostell.

So do I just ignore the email they've sent me?

& wait to see if they send me a notice to keeper letter within 56 days?

That's all you can do for the time being, unless they do ot gave your postal address. In that case write to them and appeal again saying that you cannot name the driver and you want them to continue. They do need to gave your full name and address.

Now you see why they offer a reduced charge, to panic people into paying or appealing in case they gave to pay more

Just noticed they have my address on this letter...

I would have given these details on the appeal form I guess

There us no requirement to identify the driver, contrary to their letter.

So write back go them confirming that you are the keeper and you are appealing. Don't mention the driver.

The idea us to get to day 56

Reply so that it arrives on day 26, two days before they are allowed to contact the DVLA for the keeper details

Good evening.

So I've had a reply from the company which I've attached. They also have pictures of my car parked very close to their signs 😞

Could you let me know what I can do from here please. If anything. Thank you.

So wait for the notice to keeper and see what it says. It is supposed to arrive before day 56 so keep counting. When/if it arrives then ask the DVLA who has asked for details of the car and when.

The road appears council until you get to the gates here but not after that, can the OP confirm where he was parked?

I'm not sure when entering from the other entrance here

Hi there

The car was parked just after the gates on the left hand side if that helps?

Were there any signs?

Have you contacted the DVLA to see who requested the keeper details and when?

So looks like it's private there then.

Are there entry signs? signs by where the car was parked? If so what EXACTLY do they say? Photos would help, ahowing entry signs as you approach the gate and where they are relative to where the car was parked plus good enough to read.

No effort at all in that NtK to hold the keeper liable.

You will now write an 'appeal' to Alliance detailing why the money is not owed, so the first point will be unable to hold the keeper liable as the NtK isn't PoFA compliant, no point contacting DVLA to see if they accessed details to be honest, as the Notice couldn't get less compliant. Other 'appeal' points will depend on signage and will also include lack of landowner authority.

Hopefully you understand (form reading other threads) that they will reject your appeal, that you will NOT be appealing to the IAS. You can then expect debt collection letters for a while.

IT appears from the mapping to be mixed responsibility..

https://www.findmystreet.co.uk/map

I'd make an inquiry to the councils to find out what the actual definitive status is....

I have just posted a picture showing where the car was parked & the signage etc.

I work for a financial company so can't have any bad marks on my credit rating. These letters from debt collection companies would do that yes?

Can't read the sign, can you post with more detail please.

You email the DVLA at SubjectAccess.Requests@dvla.gov.uk identifying yourself

Debt collectors can't affect your credit rating, no proof if the alleged debt.
