Hi all, thanks for taking the time to read my post.
We have received a “PCN” from Parking Control Management for parking in a Visitors Parking bay on private land. The sign post with the sign was facing the wrong way when we parked, so had no idea we needed a permit to park there. We appealed the PCN and highlighted that even in their “evidence” photos the sign is facing the wrong way round in the first photo, then miraculously it’s facing the road 10 minutes later in their next photo. The first image was also quite clearly taken from the drivers seat of a car (wing mirror is in the photo), stopped in the middle of the adopted highway. They’ve also marked the vehicle as “silver” when it’s green (if that matters). They haven’t really address anything I raised in the appeal and said twice that their signage is clear, adequate and compliant, and that we entered into a contract by parking their. How can I agree to a contract I haven’t seen due to the sign facing the wrong direction?? Any advice greatly appreciated, weighing up whether to go through the Independent Appeals Service or just pay it while it’s only £60 and accept defeat. Thanks in advance! |

I certainly wouldn't pay these crooks anything based on what you have said! Most cases are winnable if you hold your nerve and make good use of the advice you can get here.

QUOTE whether to go through the Independent Appeals Service Yes when it's PCM, highlighting the changed sign position.Normally we say do not try IAS but when it's PCM, if you've read any recent threads, the advice is to do IAS. And ignore it if you lose, and then fight it in court. Loads of PCM threads tell you this already. |
