Hi Everyone

Please I need advise and help. I receive a Notice of Enforcement on the 9th of May to pay £279 within two weeks of the issue date (which was 3rd of May). The alleged offence was on 23/11/2020 at 8.32am.
I never received a PCN, I have been at the same address since 2018. This apparently happened in 2020 in the middle of the pandemic and I am only getting the 1st letter on the 9th of may.

A baliff came to my house at 9am this morning and said the money has gone up to £514 because they didnt hear from me within the 14 days stipulated in their letter. The 14 days ended on the 16th of May (Monday). The baliff was insisting that I needed to pay £514 today if not they will clamp my car today and remove the car and goods to cover costs. He said there was nothing I can do, I can't appeal it as it has already gone to county court. The only thing I can do is pay the £514 today.


Please can you advise me, how to go about this. I have not been able to get through to anyone at the council since last week. It is not right that I am being asked to pay such an extortionate amount (that I can't afford) for something that happened in 2020 and the 1st I am receiving a letter about it is a week ago.

I am happy to send the reference number or a picture of the notice, if you need it

Does your V5C form shows the same address you are living since 2018?

Check your V5C form and confirm with us.

So the address on the V5C log book is correct in every detail? And it was so before the contravention date? You need to be sure of this.

You need to call the Traffic Enforcement Centre and ask what address the debt was registered to.

What is the PCN for and which council/authority?

Post the notice(s) you have.

I would hide your car somewhere else.

I have just been on the phone with the Traffic Enforcement Centre. The lady I spoke with, said the debt was initially registered with them on the 31/01/2022 but at my old address. So the PCNs would have gone there. The Council only recently changed it to my new address with them. She said I could ppeal.

She will be emailing me the appeal form to fill in. Should I fill it in?

What do I do about the baliffs?

What is the VRM of your car assuming it's the same car. Message me with it.

I assume you saw no PCN on your car when it was served on the windscreen?

Yes, but when did you update the V5 to this address ? Reason to ask is that the council sent the PCN and subsequent documents to your old address when they sent out the PCN at the end of 2020. To get the name and address they make an on-line enquiry to DVLA who send back what they have recorded for the V5.

Other question to ask is - is the car you own now, the same as you one you owned in 2018 ?

Date of last log book change is 13 April 2021 (silver Mazda, 2008) which is well after the contravention date of 23 November 2020. This suggests you didn't change it when you moved or you moved again.

Thanks everyone. I completed the appeal form TE9 and TE7 from the Traffic Enforcement Centre and emailed back to them. I have also contacted the baliff to let him know this is what I have done. I'm not sure what else I can do. The car was clamped by the baliff when he came in the morning.

PCN was sent to an old address so was not received.

There was no PCN on the car windscreen either

Come back here when you receive TEC's likely refusal.

While we're waiting, pl resolve the contradiction:

Authority used your 'old address' which, as observed by others, could only have come from DVLA's official record at the time i.e. November 2020, and,

I have been at the same address since 2018.

The obvious answer is that you did not update your V5C when you moved from your 'old address', the authority used the correct address(the one they were required to use) and that for some reason, apparently unrelated to this case(because you hadn't received any notice regarding this issue at the time) you updated your V5C in April 2021.

Anyway, as regards process if you submitted your application to TEC early enough yesterday then enforcement action should be suspended which, in practical terms, means the clamp being removed from your car. However, when you receive TEC's rejection it would go back on.
