I think the telling part was "A High Court judge said that the adviser, who held himself out as a competent legal professional", while there are 'professional' McKenzie friends I don't think the mate 'helping you out' will ever be put in that same position.

I think the telling part was "A High Court judge said that the adviser, who held himself out as a competent legal professional", while there are 'professional' McKenzie friends I don't think the mate 'helping you out' will ever be put in that same position. That depends entirely on the facts. No money needs change hands - Lejonvarn v Burgess (Ms Lejonvarn was holding out as a professional, though no money changed hands). This is why I keep telling people to be careful with the advice they give. Whether the McFriend will have insurance or other assets to cover the award is a different matter and part of the risk of using a McLawyer.
