Removal of vehicles with disabled tax class.

Please refresh my poor memory.
What legislation applies.

Now that we no longer have VED discs I can't see that there's immediate recognition.

But when it becomes apparent, what should happen? Release without fee?

as far as I know it is the BB that affords the exemption not the tax class any person entitled to a disabled tax class would be entitled to a BB

It is the BB being displayed (legitimately) that protects against removal.
Though the vehicle can be relocated to a nearby more suitable spot.
Disabled tax class is not a factor with removal

Seems to cover the normal exemptions a BB affords, in which case no PCN should be issued in the first place.

But nothing specifically prohibiting removal where a PCN is justified.

I am 99% certain removal limitations mirror the Immobilisation limitations.....
Basic comes from TMA 2004, S79
Regs are the General Regs 2007 for immobilising.

There is this from the secretary of state's statutory guidance

8.28 Vehicles displaying a valid Blue Badge must not be immobilised and, as a general rule, should not be removed. In exceptional circumstances (for example, where a vehicle displaying a Blue Badge is causing a safety hazard), the vehicle should be moved to a safe spot nearby, where possible within sight of its original location. The authorities should not charge a removal fee for the relocation of vehicles displaying a Blue Badge. They should notify the police or in London the towed vehicle tracing service in case the owner reports the vehicle stolen
