Hi guys, really struggling financially these days and things didnt help today. Unfortunately I got a Glasgow city council PCN this morning for parking on my residential streeet round the corner. Parkings really tight where we live and I know its DYLs but we have all parked at that spot in the past without any ticket so not sure what happened today, maybe a new inspector came by? The DYLs are broken there and so was wondering if it was worth appealing.

Looks like you are bang to rights there.
There isn't much wrong with those double yellow lines that would cause anyone to miss them. |

There isn't much wrong with those double yellow lines that would cause anyone to miss them. +1 You need something much stronger to get out of this one, I'm afraid. One appeal argument that comes to mind is "legitimate expectation", namely although parking is not permitted there on or off the carriageway as the DYLs apply to the property line, , you have parked there many times before and not got a PCN. This has won appeals in England the past, but you will need some details on your parking that lead you to believe the DYLs were not enforced. Note that Scotland are still on the old 1991 legislation, not the Traffic Management Act 2004, although it makes no difference to your appeal. DYLs don't have to be in perfect condition, merely "susbstantially compliant". In other words, would a reasonable person understand the intended restriction? In this case, i suggest they do.
