recently received a PCN BY94194940 for a bus lane infringement from Bromley council.
I(red nissan VA61EWX) was turning left following the flow of traffic. when i was impeded my blue volkswagen and in order to avoid an accident I drifted into the bus lane unknowingly but I exited out of the bus lane as soon as i safe to do so. would that be a valid explanation in order for the PCN to be cancelled? Here's video - it doesn't show what happened after you went into the lane and I I'm not sure it really shows you were impeded - see what others say.
It's worth posting the PCN so we can check for errors. |

I see the vehicle clearly enter into the left hand lane and drive a little in it but where does it pass a bus-lane sign?
There would have to be a clear visible one on the road it would pass around the point the line goes solid. Is that all they have? |

My concern was that you turned right from a left turn lane you impeded yourself. That said you can argue that you crossed a broken white line( this is allowed as per TSRGD 2016) and that you moved over as soon as you realised that this was still a bus lane. The lack of the statutory blue sign caused any de Minimis incursion into the bus lane

I would certainly challenge - post a draft here first. With London bus lanes you also get an appeal stage too before adjudication - so three bites at it if you want.

Dear Sir
Please accept this letter as formal representation against Enforcement Notice as detailed above. My appeal is based on two specific grounds: 1.I am unfamiliar with the area and I found myself in the left lane trying to turn right. in order to avoid an accident and to make the unnatural and unsafe sudden “swerve” I entered into the broken line( this is allowed as per TSRGD 2016) , whereas you can see in the video. upon completion of the manoeuvre I moved over quickly and safely as possible as i noticed this was still a bus lane. 2.Upon entering crystal Place Parade road the lack of the statutory blue sign caused the de Minimis incursion into the bus lane. 1.I am unfamiliar with the area and was turning right into Crystal Palace Parade. I can see from the video that to give space to the van on my right I entered into
into the broken line at the start of the bus lane but quickly moved safely out of the lane, which the video doesn't show. 2.There is no blue bus lane sign at the start of that stretch in Crystal Palace Parade according to Google Street View that would have alerted me to the time of operation of the bus lane, but in any case I exited it without driving in it for more than a few feet.
