Hi,
Can anyone tell me if the 14-day deadline to serve a Penalty Notice by Post - Notice to Owner applies if it was recorded using ANPR? I got a notice last week for parking in a station carpark on the 6th June with a car I had borrowed, but could not register using the companies app. I emailed them at the time but got no response. I have appealed saying that I tried to pay but could not and sent them the email - doubt I will succeed with that one! I then got another notice today for parking in the same station carpark on the 29th May with another car I had borrowed, but could not register using the companies app. I emailed them at the time and they registered it but did not reply when I asked how to pay as we were by then half way through the day. Any thoughts? |

If the car park operator uses POPLA as the second appeal route, then they should be abiding by the POPLA guideline that states the Byelaws ANPR NTO letter should be delivered to the keeper no later than 14 days after the date of the alleged offence. Any later and POPLA will consider that the penalty notice was incorrectly issued and you could win an appeal based on that argument.
However, if the parking operator uses ITAL as the second appeal route (as is the case with Indigo aka SABA) then we have the insane situation whereby ITAL thinks it's okay for the Byelaws ANPR NTO letter to be delivered any time up to 7 months after the date of the alleged offence. EDIT your post NOW, never give any indication of driver ID, you are 'the keeper', 'the driver' was driving.
If you are not the registered keeper then the Notice to Keeper timing isn't relevant, if its late it just helps drag out the 6 months within which they have to summons the driver for any alleged offence.
