I received the letter below in the post. They ask for the identity of the driver. I cannot for the life of me remember this and neither can my wife. We were both off work at the time with the kids and it could have been either. I emailed them for more evidence but the reply i got was the following...
"I can confirm that the offence was witnessed by an officer on a private motorbike. The driver of the range rover accelerated around the motorbike at the red traffic light and turned right at the junction. There is footage of the incident but this will only be released if a case progresses to court. It is the registered keeper's responsibility to know who is driving their vehicle at all times. The form sent to you will need to be completed with the details of who was driving and sent back to us as soon as possible, as required by law" What should be my next move? Dear Mr ... "I have contacted the officer for the footage and obtained a copy. I have reviewed the footage with my manager and have agreed to close this case as the vehicle is seen going through a red light 1 ½ seconds after the lights change and deemed that this would result in a hazard if you attempted to stop. As the video is personal data, and it is no longer subject to the legal proceedings exemption (because there no longer are any actual or prospective legal proceedings), you could ask for a copy by making a subject access request. This seems highly suspicious because red light cameras normally engage between 0.5 and 0.9 seconds, and I know as a fact that many forces will proceed against drivers who go through a red just 1 second into red time. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

I think i remember the incident which is why I know they dont have the video evidence, or at least anything admissible.

You know they don’t have it... but if they do have it it’s inadmissible?
