This relates to an "offence" 2 years ago - I stopped for a minute and was caught on camera - the usual for this location.
I have just received another letter ( one of many now ) from BW Legal. This is an offer of a 40% discount to settle the claim they are making. They are now asking for the sum of £92.50 (was £154.00) I have read many threads relating to this location and the most recent ones seem to have shifted stance in as much as what was thought of as a guaranteed result if it ever went to court, to now a little more tentative. What would be the advice of the more wizened forum members ?? As an aside - not sure if it matters. I identified myself as driver in my very first response to them - stupid I know but I cant change that now. All advice greatly welcomed. Thank You |

That's the second time in as many days that I have seen that special discount offered. Not that it's anything special as they cn't claim their £54 legal expenses anyway if it ever got to court.
They are trying court now but nothing has, as yet, been decised that I know of in those cases that are defendended. Naming the drier just makes it a little harder to defend but there can still be no contract to brach as it would be impossible to read the signs without stopping. It is also RTE roads and therefore only the police can prosecute. Respond to them but point out that they can't claim the £54 legal fees in the small claims court so theire discount is not really that good. I presume the letter says that their clinet may ask them initiate legal proceedings. |

I am assuming this is a roboclaim with a return address to Huddersfield, written on cheap paper. It is one of the 20,000 they claim to send every month. That sounds like they are chancers and not really a firm you would trust your legal work with.
If they are saying it's a 40% discount they should be demanding £114. You say they are begging for £92. If you do the Maths then that is more like a 60% discount. That sounds like they are just plucking numbers off a tree. The people in the main office in Leeds have no idea what is being sent out. (I would feel sorry for them but I can't as they have chosen to work for people without ethics. But then again the high turnover in staff must tell us that some people who go to work there realise it is not the best of places to further their career.) Have you had a Discount Offer before? Is this one headed "Without Prejudice"? |

I think your math may be off a little.
£154.00 - 40% (£61.60) = £92.40 However, yes the letter was headed "without prejudice" and yes, its the first such letter. |

This looks like bw lowering their expectations. Originally when they offered 40% discount it was 40% of the actual pcn. They were still claiming the £54. So that's 60 + 54 = 114.
They are now being very generous and offering a 40% discount of the legal fees as well. Hooray! One only has to pay £92! One is really tempted to contact the portal that provides the functionality to speak by webchat with a helpful member to take advantage of this offer. Sounds hilarious doesn't it? I am just wondering why they are now sending these letters "without prejudice". |

I know it's so a judge won't see it.
Why would they have sent out Discount Offers openly in the past and now they are Without Prejudice? Is it because they have offered two different 40% discounts? Or is it because they don't want more attention brought on themselves because of the interest in Parliament and elsewhere? I don't actually understand what bw are up to at the moment. They seem to be on a roboclaim avalanch at the moment. Are they desperate? |

The fact remains that thousands will pay these to avoid court. It's extremely profitable.
