So just over a week ago the car I own went to a Toby carvery. The driver Didn’t even notice there was signs about registering your number plate and parked up waited and left. They was there for 20 minutes and a couple of seconds.
The driver did go inside to the bar and didn’t know They needed to register thr car. Infact They picked up a mate from there not so long ago and they didn’t hear anything (possibly stayed for under their cut off point I guess). Do they have any leg to stand on or they going to have to suck it up as a mistake and not looking at signs. Don’t even know why they would need that kind of enforcement there. Your link returns an error code.
EDIT your post to avoid identifying the driver. Use 'the driver.' This is CRUCIAL. The driver parked and entered the pub, but has nothjing further to do with the process. You are the registered keeper and have received the PCN, which will then be appealed with help from here. Post a copy of the PCN, redacting personal and identifying information but leaving dates visible. Get pics of signage. EDIT the image. You have left the PCN number. Also, your name and address grin through the black. Post the back, as well.

POFA fail, did not give 9 (2) (e) in the format required by the act, no period of parking, moving in front of cameras is not, by definition, parking

And possibly prohibitive sign. The sign says "authorised vehicles only", your PCN says "...not authorised". There is not an offer of parking for those vehicles not authorised therefore there is not contract and therefore there can be no agreement ot pay nor any alleged breach.. The only claimant is the landholder and then only for nominal trespass.

The driver didn’t exit the vehicle so couldn’t answer that.
As friend said that was outside the entrance yesterday. |

An appeal from the keeper outlining the POFA failures and therefore no keeper liability. And the prohibiting signs incapable of creating a contract.

Euro Car Parks Parking Charge Notice at Toby Carvery Bexleyheath.
I also was given a ticket when parking (and eating) at Toby Carvery in Bexleyheath - a week later I received a fine in the post for £85. I had not seen any signs when I was there, but research showed that Toby Carvery will register your numberplate at the time (if given) and you can park for free. So I called them, 020 8303 3337 and left a message. The next morning a lovely man rang me back. I explained. He asked me for the Reference Number on my letter, and said he would send an email to Euro Car Parks straight away (he was clearly typing it as he spoke to me), to cancel the parking ticket. THANKS BEXLEYHEATH TOBY CARVERY....very much appreciated. |
