Hi,
I have received two of these letters and would like to know where I stand in appealing / not paying? Any help would be greatly appreciated. Thanks! |

Byelaws
They use the byelaws for the removel of vehicles. S4.4 So they aren't using PoFA at all in the management of the airport and have no legal authority to do so. PoFA can only apply to Relevant Land. Having byelaws puts it outside that description. Soft appeal. I appeal this ticket on the basis that there is no legal right to issue it within the provisions of the Protection of Freedoms Act 2012. This act excludes land that is subject to statutory regulation and the fact that the airport is governed by the byelaws places this ticketing as unlawful misrepresentation of authority. I don't know if telling them you want a POPLA code is in accord with them failing to go down the route they've taken anyway but it's always worth doing to cost them the £27 -------------------- The Asda shopping trolley parking ticket enthusiast

APCOA NTK which followed a windscreen ticket here (sent late and no mention of pOFA 2012 wording needed):
