All the news reports seem to be clones with the same text.....
It’s hard to know what happened, I wonder if after being stopped he was then served with S172 notices and he still declined to name the driver. I’m wondering why PCoJ wasn’t used. I do know his insurance is going to be a bit pricey at renewal! -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

I’m not sure PCOJ is appropriate.
I make 27 x 6 162 so don’t know where the extra 10 points came from. -------------------- Moderator

I'm sure there are hundreds like him; the police haven't the resources to chase up very case. His error was speeding on the same road just a bit too often. Around Crewe here there are a large number of cars with Polish plates. I doubt the owners ever go to Poland.

If it was an unlawful use of the Belgian plates (that he should not have been displaying them in the first place) intended merely to avoiding the legal repercussions of his actions (speeding, parking etc etc), it would seem a slam dunk PCOJ (I accept we don't have enough facts to state that is the case here, but it seems likely to me). -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

The article says the car was registered in Belgium, and the offences occurred over a time period that could have meant Belgian insurance covered him. What act? Which investigation? The usual PCoJ questions... From the CPS site: QUOTE The course of justice must be in existence at the time of the act(s). The course of justice starts when: --an event has occurred, from which it can reasonably be expected that an investigation will follow; or --investigations which could/might bring proceedings have actually started; or --proceedings have started or are about to start. Removing your number plate and then going for a record-setting lap of the M25, for example, would have the act (removing the number plate) preceding the initiation of the "course of justice"--which is not what the CPS would apparently consider PCoJ. --Churchmouse |
