I really need help from you guys ! I moved house back in June 2017 and didn't change to my new address on the logbook till January 2018. Today I went to collect letters from the new owners at my previous address and shockingly received about seven letters in total all from Bank Park Management Ltd. They issued Notice to keepers, two in December and one in January. I am also in receipt of a one letter from a company called ZPPS chasing the debt from the first offence. As I only received these letters today obviously the 14 days has lapsed and I am now looking at a debt of £360 in total (£100 for each 3 offences and one £60 admin charge from ZPPS). However, all three offences occured by the driver , but the letters addressed to me as I am the owner of the car. All three incidents took place at The Farleys Centre in West Bromwich. The three notice to keepers are for the following reasons: two for not paying for a parking ticket and one for overstaying. I asked the driver if that is correct and he reckons he has paid for parking tickets for two offences mentioned but on one occasion - the first offence-he did not pay because the machine was out of order. He took a photo showing machine out of order. My understanding is this company operates by clicking images of vehicles as it enters and leaves the car park. However, they did not stick any PCN on the vehicles at any stage. Therefore, the driver is oblivious to the fact that he may have commited an parking offence until a notice to keeper is received. Can someone please advise if there are any grounds for appeal and if it is not too late to do so? How can I go about it, is there any loophole? I am extremeley worried I might get a letter from the court now for something another driver did and not to mention my credit score may have already been affected! And the total of £360 is a lot of money for something we are not aware has actually occured! Please please help? Any suggestions/advice? So post up the the PCNs you received, redacted of identifying details but leave dates. Photos of signs would also be helpful.
You will need to respond soon giving them your address so that they will not be tempted to try court in the hope of default judgement as they have had no response. Might be worth an email to the DVLA asking who has applied for the details of the car, how many times and when. Details are in the forum. Post up one of the NtKs with identification details removed
Don't forget any payment slip at the bottom Leave the dates of the parking event and the Notice In order to recover payment from the registered keeper, the Notices must not only arrive at the DVLA-provided address within 14 days but they must include certain information Even if the Notices are valid, the ZZPS charge can't be recovered from the registered keeper Good advice about checking with the DVLA Bank must make a separate application for every parking event They can't use details on file to save £2-50 each time This post has been edited by Redivi: Thu, 22 Feb 2018 - 09:50 |

Hi
Can someone please let me know how I can upload pictures of my pcn by reducing them? I tried uploading using my mobile phone and attach a photo, wouldn't allow me as file too big. Tried same using my laptop and scanned images are too big to be uploaded. I'm sure there is a way of reducing the pictures and uploading. Can't remember how. Please help |

The FAQ are on the first page of the Forum
That example isn't a valid Notice to Keeper although the others may be if Bank made separate applications to the DVLA for the keeper details Although it contains the information required by the Protection of Freedoms Act, it was posted on Friday 29th December It's deemed delivered two business days later 1st January was a bank holiday so it wasn't delivered until the 3rd, more than 14 days after the parking event Bank can't therefore recover payment from you as the registered keeper Check the dates on the others and ask the DVLA about the applications for your details Could also complain to the DVLA that Bank has untruthfully claimed that POFA applies to a Parking Notice that they knew was too late Enclose a copy and ask for Bank to be suspended from access to the keeper database while it's investigated This post has been edited by Redivi: Thu, 22 Feb 2018 - 14:38 |

Ok I will check with DVLA. Is there an email address that you suggest I should email them to ?or shall I just browse online to see if I can find an dvla email address?
There is another letter they issued on 29 Jan a month later- but I am still trying to reduce pictures to upload. Will upload all documents once I figure it out. If there is a link for tinypic- would be grateful if you could send it.i am looking aswell. |

This is the 4th page of the first Notice to Keeper.
I will try to upload the remaining documents once I figure out how to reduce them. In the meantime I will be very grateful if someone can let me now what I should do now? Shall I write to Bank Park Parking Management and inform them of my new address? How shall I word it? Shall I mention that I was not the driver but not tell them who was? I would be very grateful if someone cpould draft me a quick letter or email that I can send them. I am concerned of the time that has lapsed already and want to stop any court letters. If theyre all the same, I woudlnt bother doing more
TINYPIC is your best bet, same as everyone else, if you insist on uploading them. You appeal to them, giving your new address. DO NOT identify the driver, obviously! Simple deny the debt, metnion they failed to meet the requirements of POFA to hold the keeper liable, and you were not the driver so cannot have any liability. You suggest they contact the driver, . |

Thank you so much. Yes I will draft a letter and upload it for your checking. Just want to check if I should send a letter to Bank Park Management Ltd only informing them of my new address or also one to ZZPS as I also received a letter from them for the first offence?

Try this:
I have received your PCN xxxxx as keeper of vehicle xxxxxx. Your notice to keeper was sent on December 29th, a Friday, and, as you have said, is considered delivered 2 working days later. As January 1st is a bank holiday then the notice is considered delivered on Wednesday 3rd January. This is more than 14 days after the event and therefore contrary to the requirement 9 (4) of Schedule 4 of the Protection of Freedoms Act 2012. Because of this you cannot hold me liable for the action of the driver at the time. I have no legal obligation to identify the driver at the time and I will not be doing so. I do not expect to hear from you again other than to confirm that no further action will be taken in this matter. I draw your attention to my current address as I have recently moved and expect any responce to be to the new address. So upload the first 2 pages of the other PCNs you have received to check POFA compliance, though you could check yourself. Here's a link to POFA, you should look at paragraph 9 As noted in post #8 the FAQ are on the first page of the forum and include instructions on how to upload images to the forum. Can I please check that how is it more than 14 days after the event occurred? Because it happened on 18th December which is a Monday. If I count 14 working days then it falls on 4th January for me. or is that because you have taken the Xmas day off on 25th December? Sorry just trying to understand how it works. Thanks |
