This is a rumination more than anything.
My stepdaughter recently got convicted of speeding over the Dartford Crossing (again ). We didn't contest as she admitted it was more than likely she had been slightly over. Anyway, she paid the fine of £100 but forgot to send her licence off to be endorsed. The next we knew was a prosecution letter stating such & a refund of her fine. Apparently a reminder was sent beforehand but it didn't arrive. She then got a letter stating that the fine had been increased to £107 with £30 victim surcharge & court costs of £85 plus instructions not to send her licence off unless DVLA asked for it. After a few days she called DVLA & was told she needn't send her licence as three points had been added to it on the computer system. So the original fine was doubled for not doing something that technically isn't even required to complete the task of adding points, increasing the original by a trifling amount & adding the surcharge but mainly by the addition of court costs for convicting someone of not doing something that isn't 'technically' required, which would seem at face value to be a bit of a 'do not throw stones at this notice' situation. If sending the licence was important in the first place, why didn't they want it in the second? As l said, a rumination but opinions are welcome. The court or DVLA should check the licence, it sounds like the court ticked the wrong box stating they had seen it but told you the right information. DVLA then are acting based on the information received by them.

So the fine for not doing something that technically isn't even required But more importantly, is required by law. -------------------- |

They were two different processes. The first was not a fine, but a conditional fixed penalty, one of the conditions being to send in the licence. She failed to comply with all of the conditions, so the offer was withdrawn and replaced by the underlying criminal offence, which carries greater penalties. The law has not caught up with the reality, that's true, but there's nowt you can do about that...

The law has not caught up with reality because at the moment people still have pre-1998 paper licences which are valid without a photocard.
It must now be a fairly small number but I imagine if the government forces them to be forfeited the Daily Mail will be up in arms about people with "British" licences being forced to get EU ones instead. Even my Mum, who is normally fairly intelligent, complained for a long time about having to change it because she moved house in 2013. Seeing as people seem to struggle with the current fairly simple "send us your licence" instruction I can only imagine there would be even more people getting it wrong if it then became conditional. |

It must now be a fairly small number 2 in our house of 5, not sure I'd use that to extrapolate it to 40% of all licences though! 1 in our house of 4 drivers. And I am not changing it until I have to, kicking and screaming while writing to the Daily Mail about it |

A simple, "You do not need to send us your licence if you have a photocard licence" would do it... There's ample evidence that it'd take a damn sight more than that, including pictures, to avoid the dribbling hordes getting confused over which type of licence they have and what to do with it. -------------------- Regards,
