Is this a live ticket? Their website says nothing, not even a hint at which ADR they may use, but I have discovered that they are IPC so the secondary appeal will be a waste of time.

If it is a ticket, please post, redacted of identifying detail but leaving dates and location.

The usual routine with a NtD is to appeal as keeper to arrive with them 2 days before the expiry of the appeal period so that they have information about the RK that they don't have to pay £2.50 for. Hopefully, they respond without applying to DVLA which gives you another winning PoFA point.

Live ticket.
Driver got it tonight (Last night, 11th Jan)
Will scan and post tomorrow.
Location on ticket. Cliveland Street
But was in a car park.... Birmingham.
Back of ticket does say IPC.

Yeah. It's the usual 'appeal as keeper to arrive on day 26, then ignore' routine.

Post a draft appeal here for approval or search some Ostell drafts.

Resurrecting an old thread.
Seems that DCB legal are now involved.
Way back when PCN was found, sent a brief email to Premier saying that the driver had found a PCN but had experienced difficulties with the machine so had been unable to pay...sent as the keeper.
No response.
No further letters or emails or notices received until
Received a Letter Before Action from DCB dated 12/10/20...didn't arrive till a week or so later
MEa Culpa...did nothing with it
Today received a claim form from County Court Business Centre.

I know I have to acknowledge the claim and not to put anything in the defence box.
I have no particulars on the claim except what is on the claim/LBA holding the keeper liable as keeper or driver.

What else please guys?

So was the ticket appealed by the keeper? What was the result? Has a Notice to Keeper been received? Have the DVLA been contacted to see if keeper details were requested

Ticket was appealed by email by keeper and identified as keeper
No response
No NTK Received
Nowt recieved until LBA
And now Court Papers

LBA wanted £160, costs and Parking fee but no breakdown
Court papers total £258.76 Broken down as Amount claimed 183.76, court fee £25 Legal Rep Costs £50.

Paraphrasing, I'll sanitise and scan if you need.

Defendant is indebted to claimant for parking charge issued to vehicle XX at Cliveland Street
PCN details are Date and Number
PCN issued on private land owned or managed by Claimant
Vehicle parked in breach of T&C signs (the contract) thus incurring the PCN
The driver agreed to pay within 28 days but did not.
Defendant is liable as driver or keeper
Despite requests the PCN is outstanding
The contract entitles the claimant to damages and the claimant costs
£160 being the total of the PCNs and damages plus interest at 8% per annum from the date hereof (think that is the claim date) plus court fees and costs.

Looks like they`ve added the usual £60 for debt collecting. This should be challenged in your defence.

Have you sent a SAR for all documents they will rely on for this case in court?

You may not get these back in time though.

Just to close this off.
Court hearing was due mid September, telephone hearing.
Received letter from DBC last week dropping the case.
Copy of notice to court attached.
Nothing from Court yet but I'll check online next week to make sure it has been processed.

Would love to be able to point out something clever that prompted their withdrawal but I done very little bar acknowledging court notices in good time and submitting a defence which was basically POFA doesn't apply so no keeper liability, no proof of driver, no evidence, only an NTK and inflated costs.

I'll take the win.
