Well presuming it’s sent to the UK registered keeper it probably isn’t Volkswagen Aktiengesellschaft either. More likely Volkswagen group UK ltd

No.
Volkswagen AG is VW Aktiengesellschaft, not VW Audi Group. It is the brand owner for those I have previously listed.

The NIP came to the postroom, addressed to Bentley and was then immediately recorded as delivered. The postroom then sent it to the relevant team.

Who are Volkswagen Audi Group? I can't find a record of any such company (and its not registered with UK Companies house anyway so unlikely to be a UK registered keeper), but it is a commonly misunderstood expansion of VAG (even in VAG UK companies, two of which I have worked for) which is of course actually VW Aktiengesellschaft.

I'm confused by the reasoning

Was the charge dismissed because he proved that the letter arrived late or because the police couldn't prove that it was sent First Class ?

There is a link in another post to a Daily Mail article but the gist is that the argument that the NIP arrived to the RK a day later than it should have was accepted by the judge. The offence was on the 23 January and I think it arrived on 7/2 instead of 6/2. Mr Freeman seems to be blaming Bentleys postal system but I dont quite know why. Teletext says DB wont be prosecuted because of this but I assumed thats what these Court proceedings were for but perhaps not.

I'm confused as well . Does it matter if it was sent 1st or 2nd if a nip arrives in time. ( which this one apparently didnt . How soln after the offence are nips sent out.

Posted on 2/2 ( Friday) so given there was a weekend and it was to a company it was a bit optimistic to arrive in time.

Well posted Friday 2/2 would have a presumed delivery on Tuesday 6/2 so presumably the court accepted that the contrary had been proven.

The Road Traffic Offenders Act 1988 Section 1A says that it must be physically delivered to him, left at his last known address or sent by First Class, Recorded Delivery or Registered Post

I've never heard of a business date stamping only unopened envelopes. Normally post is opened, envelopes discarded and contents date stamped.

But DB is still after that knighthood...
