I meant Volkswagen Audi Group's NIP. Did you mean Volkswagen AG's NIP? -------------------- Andy

Well presuming it’s sent to the UK registered keeper it probably isn’t Volkswagen Aktiengesellschaft either. More likely Volkswagen group UK ltd

I meant Volkswagen Audi Group's NIP. Did you mean Volkswagen AG's NIP? No. Volkswagen AG is VW Aktiengesellschaft, not VW Audi Group. It is the brand owner for those I have previously listed. The NIP came to the postroom, addressed to Bentley and was then immediately recorded as delivered. The postroom then sent it to the relevant team. |

For an added frisson of exceptment, the now infamous Constance Briscoe was once a recorder in Harrow CC, now it’s not clear if it’s the same Recorder Briscoe but the odds are pretty good in which case one wonders how someone so clearly incompetent managed to make it to the lofty levels she did (before she binned it all of course, in, erm, a display of gross incompetence!). They were probably below their quota of female District Judges! |

Who are Volkswagen Audi Group? I can't find a record of any such company (and its not registered with UK Companies house anyway so unlikely to be a UK registered keeper), but it is a commonly misunderstood expansion of VAG (even in VAG UK companies, two of which I have worked for) which is of course actually VW Aktiengesellschaft. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

I'm confused by the reasoning
Was the charge dismissed because he proved that the letter arrived late or because the police couldn't prove that it was sent First Class ? |

It is being reported that he got off. Not seen the detail yet. There is a link in another post to a Daily Mail article but the gist is that the argument that the NIP arrived to the RK a day later than it should have was accepted by the judge. The offence was on the 23 January and I think it arrived on 7/2 instead of 6/2. Mr Freeman seems to be blaming Bentleys postal system but I dont quite know why. Teletext says DB wont be prosecuted because of this but I assumed thats what these Court proceedings were for but perhaps not. I'm confused by the reasoning Was the charge dismissed because he proved that the letter arrived late or because the police couldn't prove that it was sent First Class ? I'm confused as well . Does it matter if it was sent 1st or 2nd if a nip arrives in time. ( which this one apparently didnt . How soln after the offence are nips sent out. |

If it was sent 2nd class, the date of arrival would be irrelevant because it's not a valid method of service

It was posted in time but it was proven that it arrived 1 day late. I presume P.Gidden would have been mentioned...

Well posted Friday 2/2 would have a presumed delivery on Tuesday 6/2 so presumably the court accepted that the contrary had been proven.

Doesnt actually say that the stamped envelope was produced in court but certainly someone was questioned about procedure re receipt of mail and there are previous posts in this thread about that. I'd have thought stamping the contents of such items as well as the envelope would be better- |

So what you are saying (without actually saying so) is it must be sent 1st?
That's right The Road Traffic Offenders Act 1988 Section 1A says that it must be physically delivered to him, left at his last known address or sent by First Class, Recorded Delivery or Registered Post |

I've never heard of a business date stamping only unopened envelopes. Normally post is opened, envelopes discarded and contents date stamped. But DB is still after that knighthood... Well, the Postie, ( as I recall) confirmed physical date of YOUR NIP, Peterguk,... so, hopefully, you are in front of him , in the queue...... |

According to the BBC, the DJ has accepted that the NIP arrived late, so Beckham was acquitted.
