Hi Guys,
The driver was issued with a parking charge amount of £100.00 for parking in a car park for 11 minutes and 26 seconds. The driver gets Fish & Chips two or three times a month and parks outside on the street to quickly pick up the fish & chips which normally take around 4/5 minutes if that. Unfortunately on the night there were no other area for the driver to park outside the shop and the driver parked behind the Fish and Chips shop thinking that it would only take me 5 minutes as it normally does, and that 10 minutes is normally the grace period for parking. Unfortunately the driver checked the time on his watch inside the Fish & Chips shop, once they realized how busy the shop were. The driver truthfully did not realize that they parked for more than 10 minutes. Is there any way that the driver can appeal the parking charge notice. regards, artMan This post has been edited by artMan: Sat, 20 Oct 2018 - 12:25 |

Who issued the PCN?
-------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

Edit your post so that the identity of the driver cannot be inferred. Use "the driver....." etc.
Post up redacted PCN and photos of signs. |

QUOTE Is there any way that the driver can appeal the parking charge notice. Yes if a BPA member. No if an IPC member. Either way, no-one pays these scam PCNs. Who issued it? |

Ah, they do love their 10 minute grace. I'm not sure if they are so keen to issue court claims for those though.
Does the back refer to Protection of Freedoms Act? (And it arrived within 2 weeks) -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

Does any occupant of the car have a phone with Google Location enabled?
Any proof from that to show that the 11 mins is actually 10 and PE's cameras are mismatched by a minute or two (we've seen people state exactly this before now). |

Its very simple
The vehicle wa snot on site for 11 minutes, it was on site for 8 minutes 11 seconds, as verified by this excerpt from an occupants location history. Cancel the PCN or explain how your system can be 3 minutes out. |

So we checked the drivers phone with google location and that actually shows 20:22 - 20:30 in that location which is 8 minutes and not 11. Could someone recommend the wording for the appeal letter to help the driver. AGAIN! SHOCKING. This is the second time we have seen this (could PE have some/many cameras all over the UK set 3 mins out, on purpose - people should test this!) and you MUST send this evidence to the Information Commissioner in a formal complaint. OMG. Explosive evidence and you are the second person to have exposed this scam recently: https://ico.org.uk/make-a-complaint/your-pe...ation-concerns/ Also send a copy to your MP and to Sir Greg Knight MP, please: https://www.parliament.uk/biographies/commo...reg-knight/1200 Show them your evidence. Let's not tip PE or the BPA off yet, let's make these complaints to the ICO and MPs first. Hold the appeal at the moment, you have 28 days to do that from the PCN. No rush. |
