Hi guys, thanks in advance for your help.
I was caught by a speed van doing 37 in a 30. On the 11/10/18, my office (as it's a leased company vehicle and registered to them) got the NIP today 20/11/18. The letter is dated the 16/11/18. I cannot work out which date they have 14 days from. My office have not sent the form back as to who was driving. But I definitely was and they can prove it. Can you offer any help. Callum |

my office (as it's a leased company vehicle and registered to them) If it's a leased car, the RK will be the leasing company, not your company. And the first NIP will have gone to the leasing company. They will have named your company. -------------------- |

They have 14 days to get the first NIP to the person or organisation shown as the Registered Keeper (RK). There are no time constraints on subsequent NIPs. The chances are your employer is not the RK but a leasing company is. You should ask them if they hold the V5C for the vehicle and if so whether their correct details are shown on it.
In any event they must respond to the request for driver's details or they commit a separate offence. |

My office have not sent the form back as to who was driving. But I definitely was and they can prove it. Regardless, the driver nomination must be returned. Not doing so risks a more serious offence. In any event they must respond to the request for driver's details or they commit a separate offence. Ah, didn't spot this... -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |
