Euro Car Parks - Perranporth, Actually Paid and Displayed - but now have a PCN

Afternoon experts,
It is years since I have had to challenge a PCN and I have lived a cautious life to avoid hassle ever since defeating a parking eye PCN.

I certainly hadn't anticipated receiving a PCN despite having paid and displayed on my first ever visit to Perranporth.

Our party arrived at Perranporth and parked at the Euro car parks green man car park, paid the two pound charge for a 2 hour stay (happily), as everywhere you go in Devon and Cornwall charges for parking. I paid personally and by cash (2 x £1 coins) the machine (to the left of the wetherspoons entrance) printed my ticket, made a clunk click noise, screen went blank and my coins were spat back at me - happy days I thought and proceeded to display the ticket in the car.

The machine is a Vehicle Registration machine - so I had inputted the vehicle reg accurately and we went on our way to the beach.

The PCN arrived via the registered owner (it's a company vehicle) and has since been passed onto one of the members of the party (incidentally not the driver).

Now a huge part of me wants to challenge the fact that this appears to be a technology issue - is there a case where they have to calibrate their machines?

But I wanted to seek advice from the experts here. We got back from the lovely holiday - cleaned the car and threw away handfuls of parking tickets - I genuinely paid everywhere we went and didn't once try to avoid payment.

The cars main user, is nervous as its a company vehicle - what route is best?

And yes, in future I will pay by card and keep the bl**dy receipts.

Did you check the details on the ticket at the time?

What is the reason they give on the PPN?

Can you post up a copy of the PPN leaving dates but, redact personal details.

Thanks for the responses Dave65 and ostell.

The ticket showed the reg no correctly, but the machine showed out of order (or equivalent message) on screen.

No valid pay and display permit was purchased is the reason.

The car is a company vehicle registered to the employer, but leased from a small 3rd party.

Scans on their way tomorrow as I can't scan from home - sorry.

So whose name is the PCN ? Is it the company or the employee? Again: were there extra documents with the PCN

The car is registered to my better halfs employer and their address.

We've gone through the car with a fine tooth comb today but didn't find the ticket for this date, just one for another car park in the area.

If the car is leased then how is the employer the registered keeper?

Please can you check and cone back with the correct story. If it us a leased car then there will be an easy appeal

The car is a leased vehicle which is a company car, but it is registered to her employer and the PCN is addressed to the employer.
All employees are insured to drive it

If the car is leased then the leasing company are normally the registered keeper. The PCN is addressed to the company because the leasing company gave Euro their name in order to remove liability from themselves.

Please edit your last post to delete who has the car and who is permitted to drive. You must keep the identity of any possible driver away from prying eyes.

If it is addressed to the company AND there were no additional documents then the company responds with:

Sirs

Ref PCN xxxxx VRM yyyyyy

We are the hirer of the above vehicle and are in receipt of the PCN you issued. We have no liability on this matter as you have failed to meet the requirements of Schedule 4 of The Protection of Freedoms Act 2012 namely, but not limited to, failing to supply the additional documents mandated by section 14 (2) (a) of the Act. You cannot therefore transfer liability from the driver at the time to us, the hirer.

As a Body Corporate we could not have been driving and there is no legal requirement to identify the driver at the time and we will not be doing so.

Any further communication with us on this matter, apart from confirmation of no further action, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

Yours etc.



Now you see why I was trying to get the true position.

Send first class post with free certificate of posting from a post office

P.S. Keep this handy for future use with private parking charges.

This does seem to be getting a little less common. I guess possible liability issues ?

When I had a contract hire the V5 was in the name of the hiring companys supplier.
When I had a PCP the V5 was in my nsme (daughters is in the name of the manufacturers finance).
When I had a company car the V5 was in thecompanies name. Though the company only held an operating lease on the vehicle from a finance provider.

The giveaway in thus case is the time between the incident and the receipt of the NTK. If the company are the registered keepers then the failure to deliver within 14 days would be the appeal
