I recieved a parking ticket on 13/07 for parking with one or more wheels on the footway. I was outside my house and i had 1 wheel around 6 inches over the marked bay as when i parked a car had parked in the middle of the bay so i couldn't fit in fully.

The bays have recently been reduced by around 2 feet in length which means it is very difficult for 2 cars to be parked in there.

Having only recenylt moved into a london borough i was not aware that you could get a parking fine for parking on the footway, the signage does not indicate this.

Anyway i can challenge this?

To be honest your formal representations are going to be along the same lines as the informal representations, see what others say but I don't think there's much that needs adding.

So just this then what i sent before?

"Dear Sir or Madam,

I contest liability on the basis that the alleged contravention did not occur. I have now learnt that there are footway parking signs that indicate footway parking is permitted solely within marked bays on Carter Drive, however no such signs are visible if the location where I parked on Carter Drive is approached from the direction of Larchwood Avenue. I have since retraced my route on foot and confirmed that I would not have passed any blue signs when travelling from this direction.

It follows that the signage does not comply with the requirements of section 15(5) of the Greater London Council (General Powers) Act 1974, and for that reason the alleged contravention did not occur. Should you chose to reject this representation, please would you provide a copy of the resolution passed under section 15(4) of the Act to allow footway parking on Carter Drive."

Well we could make it more wordy but frankly what's the point, it says what needs to be said.

I believe it is 56 days, not working days, from the date they receive your reps. How did you send reps and do you have a receipt. There may be a status online.

I appealed online, and took a screenshot of the confirmation which gave me a reference number and stated

"Please keep this for your records, you will receive a response to your correspondence by post or email, within 56 working days"

Check your junk/spam email folder in case they've sent something by email. But should come by post.

Not 'should come', any response must be served by post.

But check your spam anyway.

Online submission 11 Sept = last day of 56-day period 5 Nov.

Is it worth contacting Havering Council and asking them why i haven't received anything back from them?

There isnt an option to see status, only resubmit reps or pay the fine.

Now that the 56 days have expired, that's probably a good idea.

Well done, I have to say I'm somewhat surprised it was that easy but maybe the council is learning?

I guess so,i have read a few similar cases in havering that they have lost at tribunal so probably thought its not worth fighting

No doubt i will see some new signs erected nearby very shortly
