PCN and removal, newham does it again

hi friends,

They have done it again. This time i had parked my car at the place where i park everyday (no restriction) clearly displaying my visitors permit but was shocked to see my car removed. Best part is that i contacted them on the for the images for over 5 times and unfortunately they have still not send me any images infact the last one the customer assistant was very rude and hang the phone on me. now the PCN date is 2/2/2018. They have given my representation form, vehicle release receipt and this time provided with another sheet with important information.

The permit was on the dash? Have you looked online on Newham's site for pics - they are usually there.

Apart from that it's of course outrageous they tow for a lower level contravention.

Not sure if this would wash, but technically the sign doesn't require you to display the permit, just to "hold" one. So even if it somehow fell off your dashboard and wasn't visable to the CEO, you wouldn't be breaching the requirements of the sign.

Where did you get the permit? i.e. were you given it by someone or is it one that you bought yourself?

THE VISITORS PERMIT WAS CLEARLY DISPLAYED

infact i have been calling them first few attempts they would discourage you by giving that image are deleted only when you say that your vehicle was removed they speak to their managers and admit they will send it but now it is been 3 weeks but it has not been send. i called them today and lady says that she will order it fresh.

Have they said they will put the process on hold while they send the photographs? If so, get confirmation in writing or e-mail.

You must get your reps in in time to keep the process live.

Date of Release was 2nd.Feb., so you have less than a week left to submit. Post 1st class at post office and get (free) proof of posting on Saturday or Monday morning at latest. You do not have to use the form supplied..

They are almost certain to reject.

Write something along these lines, but incorporate any suggestions the experts here suggest.

re.PCN NH123456 issued 02-02-2018 and subsequent removal of vehicle [Reg.Mark].

Dear Sirs, I make representations against the above PCN and removal as follows@

Against the PCN - the Contravention alleged did not occur:
1) the permit was clearly displayed (copy enclosed).
2) the wrong contravention was used because . . . .
3) ....

Against the Removal:
1) the removal was draconian and disproportionate because . . .
2) . . .
3) . . .

In the light of the foregoing I look forward to the cancellation of this PCN and refund of all monies paid.

i have called the family to ask this question and they say this permit was new one and they are right as i filled it myself. As i am writing i just checked all some of the earlier ones which i had used when i went to newham and found that some of the serial number number starts the same that is ENQ2570343- but he last number changes now i can see 9 is the one i used but previously i had used 3, 5, and 6 as well.

There seems to be a suspicion that permit has a cross on January and on 25(th)
This may be photo and simply an impression from where a previous permit was filled in.
You have the original, does it look like it has been altered ????

And where was the permit when you picked up the car ?

lt does look like a cross on 26th as well and jan but i have contacted my clients and i usually get them blank from them i am sure i did get blank on the 2nd of feb as well. Anyhow iam visiting them this friday and check once again. They are very old couple and i would not suspect them

May I ask what you do? A doctor or pharmacist maybe? Do you need a 10 hour permit or is most of it not used?

We cannot answer the question why the CEO issued the PCN on these grounds.

You were parked 4 hours after the permit was completed. So, the CEO didn't see it at all, or did but thought it was not valid but did you a favour with the lower level alternative contravention as opposed to higher level did not display?

We do not know and no amount of bouncing around the sketchy info will lead us to the answer.
