Got a parking ticket at my residential car park

Hi All

Would you please help!!

I got a parking ticket for parking my car at my neighbour's space as my slot was occupied by another vehicle when I parked in. My neighbour doesn't own a car and he's happy for me to use his space. Tried to make an appeal to explain the situation yet rejuected (as below) by the management company.

"Thank you for your letter of appeal against the Parking Charge Notice issued by us on 19.02.2021.
Having carefully considered the evidence provided by you we have decided to reject your appeal for the following reasons:
The vehicle was parked on private land that is well signed with bright yellow contractual notices stating that a valid permit must be on clear display at all times to park.
Please refer to the attached photographic evidence of the vehicle parked in clear view of four of the contractual notices in place. These notices clearly state that enforcement is carried out on a 24-hr basis."

After all, I live here for years and the owner of the parking slot was happy for me to use his space, and I can get his consent email if necessary. They ask for 60 quid if payment made witihin 2 weeks, free money...

Was wondering, any suggstions to get out of this? If I ignore this, are they allowed to put county court judgement in my credit file?

Any help would be appreciated!

Was the invoice from the management company or from a private parking company?
Did you have a permit displayed?
Did the vehicle parked in your spot have a permit displayed.

Then your neighbour should look at their lease and see what is said about the parking space.

They are one of the most litigious parking companies so a claim is likely but they don’t just enter a judgment in your file - you have a chance to defend it first.

Even if you lost them you have a period to pay it before impacting your credit.

Well, the ticket is from a private parking company. Sadly I didn't get the permit displayed.. Didn't check the other car, only a visitor.

My contract doesn't mention anything specific regarding the parking. I doube it'd be detailed in my neighbours..

The key is, the parking slot belongs to my neighbour, and he has permitted me to use his spot temporary. Legally, does the private company have the right to pursue furhter?

You may not be able to rely on your lease for someone else's space. Likewise, it will depend on your neighbour where they have sufficient rights to have primacy over the parking company's signs...

The tenancy agreement doesn't metion much about parking rules, but it does say it's allocated with the flat..

So you need confirmation form the neighbour that he has given you permission to use the slot allocated to him
