ParkingEye: Appeal to pay reduced amount?

Hello,

The driver of a vehicle parked in a parkingeye enforced car park at South Tyneside District Hospital, South Shields. The vehicle was parked overnight as they were working a night shift. However, as this was a one-off and running late they did not pay for parking/have permit.

My gripe is that the only correspondence that I have received is attached below:

Edit your post now. It was the DRIVER who parked. Not the cats mother, not "I", not the wife.

Please read post #2 carefully, the driver parked.

Remove the 2 lines after the links

If the driver did not have a windscreen ticket then the NTK should have been delivered within 14 days to be able to transfer liability from the unknown driver to the keeper. You have deleted the dates on the letter, what are they?

Thanks for the advice. I have edited OP.

Driver did not have a windscreen ticket.

Initial letter states:

Date of event: 22/12/19
Date issued: 25/12/19
Date: 03/01/20

I assume this means it was sent to me on 03/01/20. However, I cannot be sure of when it was delivered to the keeper.

The PCN is assumed to be delivered 2 working days after posting so posted on Friday 3rd then assumed delivered Tuesday 7th. With the event on 22nd December that's 16 days after the event before it can be assumed delivered. Whoops. PE themselves recognise they have failed as there is no POFA warning on the reverse but hope you won't notice.

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.
