When going to a job interview the driver stopped at nearby parking which had 45 minutes free parking for customers, since the driver was a bit early he went inside the shop where he parked(so he count as customers now I assume) However driver did not expect his interview to be so long and basically overstayed by more than an hour and he did not pay at parking meter either.

The letter seems to be full of scare tactics which put me into false senses that he could actually ignore it ?

Also they state this themselves "we do not have evidence that a sufficient parking payment was made for this vehicle to cover the full duration of the visit" now I understand it as they don't actually know if the driver actually paid at parking meter or not, but this can be probably checked by CCTV or perhaps parking meter requires him to enter reg plates

Here is the full letter: https://gyazo.com/796c8de0f4b838764599e280b1e29195

What do you think ?

Edit your post so that the identity of hte driver cannot be inferred. Use "the driver ......" etc. Take down that image and repost after dleteing identifying details.

If you ignore it then you could get a court claim.

Suggest the following:

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or you debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Yours etc

When you get your rejection and POPLA code come back and set up an appeal to POPLA to kill it

Served too late to meet the conditions of POFA to recover payment from the registered keeper

Unless a right under POFA is mentioned (untruthfully) on the second page, they already know this

You've left the pictures of your number plate

Didn't spot the > 14 days so:

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

Yours etc

Perhaps the OP would care to merge the two. The identity of the driver can still be inferred.

Thanks, this is first time dealing with the parking ticket so sorry if I ask dumb questions. Am I right to assume that now I need to wait until they send me another letter containing popla code, although on the back side of parking ticket there is a link where I could appeal right now, should I do it ?

You appeal to the parking company and they then either accept or reject (more likely) and then give a POPLA code.

Post your appeal for critique before sending

Well I assumed I would sent word to word what you said, just change the x's in this "I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx"

What will happen if they reject?

You appeal to POPLA with the POPLA code they must supply.

I suggested you combine those two appeals I gave.

Dear Sir/Madame

I have just received your Notice to Keeper of [Vehicle Name] [Vehicle Number Plates]

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act and failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. Sincerely,

[My Full Name]

Is this good, thank you in advance for all the help smile.gif
