Hi

I have got a ticket posted on my windscreen in April and during that time I saw the man.

The ticket was upside down so, the man was not able to see it properly hence put the PCN.

But I shown it to him and he said I will update the system saying have seen the ticket but you will have to appeal to cancel it.

Which I did by they came back saying it is rejected as signboard clearly says it should be visible.

Below letter I posted in appeal:

Subject: Wrongly Parking ticket fine attached to the vehicle

This is regarding the Parking fine posted on my Vehicle parked in Hounslow (on VFS site). The Parking ticket was shown on dashboard but seems Ticket Checker had difficulty to view it. We discussed with the ticket checker and shown him ticket immediately. He agreed the ticket is right and valid but I still need to appeal to eliminate this charge from your System. Hence, below is detail :

Parking Ref no
Reason: There was valid Parking ticket there and shown it to ticket checker. He wrote a note into his system already. Please check and resolve this issue. For your reference, I have attached the ticket copy to the appeal letter.

I have already spoken to my Solicitor friend and he agreed as you have a proof of ticket with last three digits () of car printed on it. Which prove you paid valid car park charges. Hence, requesting you to act on it immediately and cancel the charge.

This is most unusual. First, it sounds like your defence was submitted a couple of months after the deadline, so it seems surprising that the claimant didn't apply for default judgement.

Secondly you normally only get one chance to submit a defence - what exactly did the court tell you in terms of allowing you to submit further detail? And was there any particular reason why they've allowed this?

Thirdly, the defendant normally needs to submit a witness statement. If you submit one for your wife, this would be in addtion to your own witness statement.

Thanks for your reply. First of all I submitted my defense before deadline and hence they assigned case to Local county court for hearing

Once case is assigned to county court they send you letter (default) telling all rules and you can still submit more documents 2 weeks before the hearing date. That is what written there.

I sent only defense statement but not witness. So, I should be able to submit more detail within next month. Anyway, do you think the defense I wrote is enough or I can add something more in it?

I think if you look closely, the court is telling you that you need to submit the witness statement and evidence two weeks before the hearing - they're not suggesting that you can amend your defence.
So yes, you need to submit a WS, but that is just a narrative of what you saw and did.

Well your defence is a muddled mixture of witness statement and bits that might constitute a defence, so it could have been a lot better. But it gives the judge a vague impression that parking was correctly paid for and the ticket ws issued in error. it misses standard stuff like poor signage. A good witness statement explaining in more detail how much you paid for a ticket, the fact you you displayed it on your windscreen where it was readable etc, might help boost things.

Thanks. In my case the ticket flipped other side on the dashboard. So, it was not properly displayed.

You cannot serve a new or amneded defence without permission of hte court. to get that permission you will need to Apply formally, costing £100, £255 if the claimant objects - which they will.

Also, my wife was the witness as she was with me. Can Wife be witness or relatives can't be?

Hi All

I wanted to update that the case was dismissed by court.

This is because they did not send proof for signage near to my parked car.
