Very frustrating experience.
On 24th June I received a 1st Reminder for a PCN that was issued on 22nd May. No PCN was on my vehicle, and a month on I had disposed of the pay & display ticket. I wrote to Central Parking Systems, explained the situation and stated the time I arrived at the car park and that I will be on CCTV buying a ticket – this will prove my innocence. I have received a letter back, stating they have ‘thoroughly investigated’ my case, and regret to inform me that my appeal has been unsuccessful. I’m so annoyed, had a PCN of been on the car on the date it was issued, I could have sent the ticket onto them – but it wasn’t and now I have incurred a £70 fine. Do you have any advice? I have searched the forum and I can’t find a similar case. TIA |

this is difficult one - assuming all else is ok regarding the TMO, lines and notices,
the wording of the PCN and NTO (this may not be so so you should check) - then essentially it is an evidential matter which will be decided on the balance of probabilities you need to gather all the evidence you can about your activities and look for any inconsistencies with their evidence - your time of arrival/leaving/type of ticket/how you paid/whee you went after etc make a formal request for any CCTV footage to the data protection officer even if you dont get it include the request in your appeal as it showsyou are confident of your case this is a lot of work and you get no compemnsation or costs from the parking appeal process (this is a scandal) you can apply for such through small claims (providied you win the parking case) but i am not sure what the possibility of winning is - can anyone else help here you can also apply the the local authority ombudsman making a claim of maladministration This post has been edited by dominicp: Sun, 9 Jul 2006 - 11:20 |

Did the warden just not see your ticket ?? Have you asked for a copy of ticket/information on original ticket, as alleged ticket was not on car ?? Ask which warden issued your ticket, how long they have worked, how much training they have received, have there been any formal complaints about their work. Could you be on CCTV buying a ticket ?? Was it a busy car park & could your visit be checked in payments system, if it wasn't busy ?? Maybe reply with a 2nd letter saying you are telling the truth and you believe thay have other evidence which can verify this (CCTV/payment at machine). If you pursue CCTV evidence with 2-3 letters, they may start to take you seriously. You'll have to hound them into submission. peterb Ps: Once I was looking out my window, warden & tow away squad were towing away another car. Warden came over to my car, had a look & started to float about ominously. I thought, he can't be about to issue a ticket, my Resident's permit is diplayed on dashboard. I ran downstairs just as he was about to start writing a ticket. I gave the idiot a good telling off, pointing to my resident's permit & sent him packing, the muppet. Most pay and display car parks impose a condition of clearly displaying the ticket on the dashboard, which means you can potentially be given a PCN if the ticket falls off or if you put it in the side window. Some authorites give their wardens cameras to photograph the dashboard as proof of failure to display but in any case it means that proof of possessing or buying a ticket is without value unless you can prove it was "clearly on display on the dashboard".
(In my petty-minded spitefulness agains traffic wardens, I like to keep a neat array of tickets on my dashboard, just so the b*****ds have to hunt around a bit to find today's) |
