Enforcement notice with the wrong address, My neighbor received a enforcement notice on my name

Hi all, I apologise in advance if I missed any forum rule , I also couldn't find any similar post .
Let's get into it
I got a ticket on 10/06/2017, on a Zipcar which I was only made aware by zip car them selves on 29/06/2017, saing that they would redirect it so that Lambeth council could reach out to me, and advised to do not pay it until the council had contacted me directly which never happen, (on the letter they said it could take as long as 6 months ) on October I tried to reach out the council to see how it was going a long and on 03/10/2017 they sent on my email the outcome of zip car challenge which was issued on 06/07/2017 ( gave me a bit of peace of mind )and now I got this enforcement notice address to my neighbour, flat Bellow with my full name ( it's silly difference, i live at 194B and the letter is address to 194A, that might be good for me ) I moved to this address on 31/05/2017 my drive license was updated on 20/09/2017 and it has the correct address ever sense , so I'm not sure what is my next step , if I can get the council to give me the chance to pay the discounted fee of 65 as I never got any letter from them or as it is already with an enforcement company do I have to take this to court with the help of a solicitor.
I really appreciate any help as I'm not sure what to do and don't what this to mess with my credit score

Zipcar notified me by email , at the time they had my old address " which was already on the account ", I tryed to get when I updated it from them but they were unable to provide me with that information like, given that we do it online without any proper checks.

They got my address wrong twice first they were provided with my old address (223 *******) and sencond some how they managed to get my neighbors address (194A ******)

* Lambeth did not aswered my email yet I'm just assuming that pcn was transferred because they have my full name , and I called "task" to find out who was their client and it's really Lambeth


I just checked the zipcar email again and it states the time place of the penalty and ticket number, it also reinforced the fact that they advised me to don't pay but luckily for me it don't say what address they will give to Lambeth so I think I might be able to use that as evidence , then I could also use the check I done with Lambeth back in october , when the Lambeth said liability wasn't transferred yet , but using that I can't say I wasn't awere of it but I could help to blame Zipcar (as I think they won't check with them to make a decision )

Or it might just be extra unnecessary information but either way I'll post zipcar email so you guys can leave your comments

Nice of Zip to refund the £15 if you are successful - I can't see why they would do this as it's admin time either way but good for them.

When you say 'provided with' you mean it was you providing it?

When you say they managed to get neighbour's address how did they do this?

It was Zipcar who provided the first time "as that was the address I had on my account at the time "

And for the sencond time they (Task the enforcement company ) must have realised they had an old address and trying to get my new, but it's a bit trick when you type my post code it shows 194a - 194b ****** together so you iether send like that or pick one of the flats and manually delete the other one, they must have picked the wrong at this point as everything a have is with the correct address , *not sure they would go to get my address

The other problem I'm having is that as Zipcar is an ongoing account , there's no hire agreement every time you rent a car you only have your online statement that show what you have used that month and unfortunately don't show the address so can't proof or even see what address they had at the time, so how do I blame them for giving the wrong address if not just porving that a live else where , from what Lambeth had at first been told

This doesn't answer the question.

What address did zipcar give the authority and did they use it?

You seem to be suggesting that 194 only came into the equation with the enforcement notice.

Post code is irrelevant for delivery, it's a sorting tool. The top line is the all-important part.

Zipcar passed the wrong "old" address 223 address and the authority and they did use it for all the correspondence but this last enforcement notice which came to 194 address

I missed that!


It took four re-reads of the thread before it hit me.

It would seem to me (and I have been known to be wrong), that all correspondence from the council had been sent to the previous address and at enforcement stage, a NEW ADDRESS has been identified. If so, there would usually have been an application made to have the warrant 're-sealed' to the new address.

An Out of Time application is the correct procedure.

I thought about going more aggressively towards the Hire Co. as I "think" TEC won't bring them back to the equation given that is a low figuere .

With some research on the matter, discovered it relates to a fine obtained on a hired car, of which the company failed to make me aware, unsurprisingly on top of that they provided the authority with the wrong address ( 223 address) hence the reason I did not received any communication of this issue until now, therefore had no opportunity to give my prompt attention to settle it.
Whereas this problem has raised from a wrong information given by a thrid party I'm confident that the TEC and Lambeth will be willing to give me the opportunity to file a SD
To support my statement I attached 2 proofs of address on my name from the time of the penalty and also the correct address where I still reside.


And as proof I'll send my council tax , and the rent agreement both dated from 31/05/2017

Is that a better way to go or to aggressive towards the Hire Co. , as you guys recommended before I'm trying to focus on blaming them, for the wrong address, therefore I did not now nothing about this until now , and just overlooking everything else that would just make it more complicated and give them room to reject my SD ,
I read some where that the council normally appeal, but as I said on the top I "think" they wouldn't go through the trouble of dragging the Hire Co to side with them .

OP, you must, must, must be clear.

An incorrect address is not a 'wrong' or 'old' address.

Examples:
Zip held address ABCD1, whether you lived there or not.
They advised authority ABCE1

This is notifying wrong address.

Zip held ABCD1
You lived at ABCD2
Zip notified authority of ABCD1

This is notifying correct address, that is the one they were required to provide, but it was incorrect because you didn't live there and had not updated Zip.

In either case, authority must use the address supplied - which they've accepted as part of their decision to cancel Zip's PCN - and continue to use until notified otherwise by a competent person.

No.
We're trying to explain that the address (223) they used wasn't wrong; it was all they had.

The 194A/B issue you've picked up on is not directly relevant to the application you are now writing.

So your general 'flavour' of your application can only now be that it was 'unfortunate' that you moved
during the progression of the PCN.

No I just emailed them to enquire about the pcn progress, I didn't give them any information at the time.

On the email I sent to Lambeth , I literally wrote that "I'd like to check on the progress of pcn **** obtained on veihicle reg ****** on date xx/xx/xxxx "
