The video supports your entry into the bus lane. Did you exit ASAP? but there is a finding by an adjudicator well reasoned that the bus lane ends at the zig zags. The sign being obscured is icing

The will/may argument is receiving a better reception with the TPT than it was and that should be included. IMO the main thrust must be that it is unfair to seek to enforce after all this time, that there are exemptions written into the TRO that would apply but you cannot readily offer explanation to support this

Separately we must refute the council summery re the address so where did the send documents to

Address 1 the address on the v5c as would be supplied to the council or

address 2 where you were living ( give us the dates for each and where it went) then the last bit re the NoR where you had to get an e mail in order to appeal let us see this e mail

Well it will cost you no more to argue that the tow was disproportionate and this has been successful in the past .

Post all the documents you recieved ALL the photos, they should have some of the removal and a GSV showing wher you parked

The notice of rejection is a legal document and must contain certain information so we need to see all of it to ascertain its validity


If it was addressed to an address different to that on the v5c and you had not requested this then it cannot be deemed served, rendering the representation accepted

Following on from my online video footage and the reason for my representation, I wish to include the following to support my case against the above referenced PCN.


I only entered the box due to circumstances beyond my control, that I dare not brake any harder for fear of losing control. I was worried they may ram me.
In favour of this is that the video only shows a reasonable gap between me and the car in front which suggests that I was driving sensibly with care. Moreover I would like to mention the weather conditions of the day, was wet and without losing control I try to stop more gentle, not just following the cars blindly.

The poor visibility of the temporary signals.
The location of the temporary signals was not fit for good service. That also hindered the driver’s reasonable prediction of the traffic movement. There were a blind approach with limited chance to see the lights or yellow box before it is too late...
The camera view is far superior to the driver view and the temporary control introduced unfairness
This is the sort of position where an approaching driver would possibly get a clear view of the traffic light.

I think the layout supports my point above on not getting a clear view until too late to brake safely in the wet road.

Alternatively the temporary signals should have been placed before the box enable clear warning and visibility for drivers regardless of the location they were.
