Never sent NTO or CC for 48J stopping outside a school, Two notices failed to be delivered to me.

Hi All,

I've started this forum due to the fact I noticed I had an outstanding fine from 13/07/18 only because i was contesting another fine online that received yesterday.
I will do my best to attach all the images i have available.

The story behind the reason is due to the fact i was told by my friend that her child school was in norwood i went to the wrong school (there's two school in the same area). I didn't move from the wrong to the right and failed to visually see any parking restriction for the school.

Fast forward to yesterday, I'm shocked that I never received anything in the post.

My friend went back to the school today and took two pictures which I'll do my best to attach accordingly.

In full i would like any amount of help as to what i should do. I haven't made any contact to Ealing Council as i'm following the house rules.

Please someone help me to figure out what to do next.

You need to call Ealing and find out what stage they are at with the PCN and what address the two missing notices were sent to.

No direct number. Called Ealing council operator who told me Ealing can not speak about PCN but from what information I have her I should E-mail them and she provided me with the Ealing address.

Before I start to construct an E-mail, my main reason would be around the fact that in over 56 days since the contravention they failed to inform me even though they have the correct resources to do so as they did with my second contravention. There failure to post to my registered DVLA address could of left me at an financial disadvance due to there incompetence.

Any further advice?

Or should I just request the original PCN be sent to my correct registered address?

Presumably we're referring to *****863, yes?

In which case a Charge Certificate has been issued.

The formal procedure is that you can do nothing with the CC and must wait until this is escalated by the authority to an Order for Recovery at which point you would be able to get the matter reset to the PCN stage, see the following:

So, option 1 is to play a straight bat and wait for the OfR. But the obvious issue of the PCN having gone astray could resurface with the OfR doing similar which would then get messy.


Option 2, which is what I suggest, is to write to the authority, refer to the PCN, say you've only become aware of this because it's a linked PCN to PCN ******** but that you didn't receive it, accept that the normal procedure would be for you to wait for an OfR and submit a witness statement but ask whether they'd be happy to short-cut the inevitable, and save the court registration fee, and resend you the PCN.

Dear Ealing Council,
 
In regards to PCN EA**63. I've only become aware of this as I logged onto “Ealing Parking ticket viewer” to view PCN EA**71 which resulted in seeing PCN EA**63 but I didn’t receive anything in regards to this PCN.
I accept that the normal procedure would be for me to wait for an order of recovery and submit a witness statement but I ask whether you would be happy to short-cut the inevitable, save the court registration fee and resend me the original for PCN EA**63.

Does the case status show what stage it's at? i.e. charge certificate, order for recovery etc...?

As I've just explained in another case, it's you that has unknowingly delayed this; by
contacting Ealing.
