On 17 March 2023, my dad parked his car in the Love Lane car park, Pinner operated by Harrow Council. The first hour is free and needs to be validated with the PayByPhone app.
He entered an hour into the app, clicked continue and got the "Confirm Parking" screen. He thought this had completed the process but unfortunately, he missed the Park button at the bottom to confirm this. Having just used the app, I can see how this mistake would be possible - the UI is not ideal. Obviously, if he had had to pay, it would have been obvious he hadn't completed all the steps as no payment screen would have been presented yet. My dad left the car park within the free hour but upon returning home, found a PCN (photos attached) stuck to his windscreen. He was confused as he thought he had used the app correctly. He opened the app on his phone to find the "Confirm Parking" screen was still there and so he took a screengrab. This shows the parking would expire at 13:12. We have a number of pieces of evidence to show he was only in the car park for an hour:
I realise that none of this negates the fact that he didn't validate his parking correctly with the app. However, given it would have been free parking anyway, the council are not missing out on any revenue. He is a 74-year-old man undergoing cancer treatment so I think it's understandable that he might not quite have his wits about him for this. He appealed the PCN but unsurprisingly, this was rejected (photos attached) by the council (do councils ever not reject a first appeal?!) I was hoping someone could comment on whether it is worth pursuing this further to tribunal or he should bite the bullet and pay the £30 fine. Many thanks for any advice. |

A carefully crafted representation might see this off, but you'll need to wait for the Notice to Owner. Is the car registered to your dad and does he have the V5C?
