This letter has arrived stating that the driver of a car overstayed at Pease Pottage services for a short period of time. Any advice on next steps appreciated.

They got within 14 days at least, but still fails to use PoFA:

Dear Sirs,

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

Online is ok as long as it doesn't request driver details/confirmation.

There are two checkbox options, one to "confirm you were the driver" and a second as follows:

"Tick here to confirm that you were not the driver or that the PCN you have received contains incorrect information"

Is it acceptable to tick this second box as the PoFA response draws on the fact the PCN contains incorrect information?

What incorrect information does the PCN contain?

Being PoFA non compliant is NOT incorrect information.

Perhaps post with free proof of posting is better to avoid the 'trap'.
