Yes you are right !

I saw the difference in date of conviction and date of offense ! So my old post had the date of offense ( August 2005)
while the latest post has the right date ( March 2006).

Thanks

Hello Gaza,

Thanks for your reply,

You are right about missing the Driver's awarness test, however, I could not attend because I was not physically in the city. Anyway, we will see how this goes. Back to your original question I received a notice for summons for the 29th of July.

Cheers,

Well spotted Southpaw82,

Ideally what I would like to happen is get away with this one and the other offense the verbal NIP, I 'd take the points because if the case is after August 2008 I will have my first 3 points off because it would be 3 years since I ve had them.

Thanks for your comment !

Hello Jeffreyarcher ,

Thank you for your reply. This is exactly why I am a bit skeptic of their decision. There was no mention of a completion period in the T&C or any other document.

Any ideas if there was a completion period, where would it be mentioned ?

Thanks

NIP Details and Circumstances
What is the name of the Constabulary? -
Date of the offence: - November 2007
Date of the NIP: - 4 days after the offence
Date you received the NIP: - 6 days after the offence
Location of offence (exact location as it appears on the NIP: important): - A3024, MAYBRAY KING WAY , SOUTHAMPTON (FIXED CAMERA)
Was the NIP addressed to you? - Yes
Was the NIP sent by first class post, second class or recorded delivery? - First
If your are not the Registered Keeper, what is your relationship to the vehicle? -
How many current points do you have? - 11
Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons -

NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

Hello all,

I have received a written NIP for doing 36 on 30. I have replied back asking for the evidence and the evidence was shown to me, clearly identifying me as the driver. I did accept and replied that I was the driver. I have then received an option saying that I could take a driver's training course for 74 GBP instead of the 3 points and 60 GBP fine ( which was great because I have 11 points on my licence). I did arrange to attend the course, paid the fees etc, but due to work commitments I could not attend. The same day that the course was due and I was away, I called the Driver's awarness company asking to reschedule and the told me that it was not possible because it has been quite some time since the offense happened. The company representative suggested me to contact the police. I did call the police to ask for a reschedule and I was told that it is not within his authority to allow that, so the case will have to go back in court.

I have put the events in a timeline format in order to show what has been going

The letter from the Ticket Office giving the driver's awarness course as an option

I am also appending the terms and conditions of the driver's awarness course. It is clear that there is no reference to the duration between the rescheduling of the course and the

I also have the support from my Company explaining why I could not attend.

What would you advise me to do in court ?

Thanks

Hello all,

I would truly appreciate your input on the following case of mine :

1. On the 3rd of April 2008 I have been followed by the police on M40, an undercover Astra. i have been driving on the right lane coming back from a long business week home. After following closely, I decided to pull over on the left because I thought someone wanted to overtake me. Eventually I slowed down and stayed in the middle lane, and then the police car decided to turn on the blue lights and pulled me over.

2. There were two police officers one man and one woman. Both of them very kind. They did explain to me why they pulled me over. They had recorded a speed of 106 MPH but the lowest speed was 95, so they decided to use the lowest recorded speed (very kind of them). I did point out that I already have 11/12 points on my licence and my first 3 points are due to expire in August 2008. The officer offered to show me the video and explain to me how the equipment work, but I hadn't been on those forums before (stupid me, I know) and said I have been told this before. They have logged my licence and I have given them my name and correct address. They decided to issue me a verbal NIP.

3. After reading this forum I understand that I will be waiting for the NIP to come through the post within 6 months. If it doesn't arrive then the case is not valid.

What are your suggestions for my case. I do understand and believe that speeding is an offense and not an issue to be taken lightly but I do not support that all cases should be treated equally. All of my past 11 points have been given to me without presenting myself at the court ?

Please advise.

Thank you for reading my post !
