Hi, in reference to a PCN received from Parking Awareness on 06/05/2020 (with two follow up letters since their original letter).
The place the vehicle was parked is somewhere frequented and the Security Officer (SO) always registers the vehicle registration to permit/authorise its stay (note: this is not a permit one must display). After several conversations with the SO, they advised that they reached out to Parking Awareness to challenge it, with the SO later confirming (over the phone) that the PCN should now have been cancelled. However, Parking Awareness have sent two further letters since the SOs verbal confirmation. Can you get written confirmation that they have been requested to cancel?
Have you got a photo of the sign? Yes, they cannot claim from the keeper as they have missed so many of the requirements of POFA, only the unknown driver. Edit your post so that the identity of the driver is not inferred. |

Thanks for the feedback, post has now been edited.
No photos of the sign, unfortunately, nor any written confirmation from the SO (they tend not to respond to emails so communication has been over the phone and in person). Will try to get a written response from them by sending this latest note. Due next in the area next week, so can obtain a photo of the sign then, if this would be helpful? The charge is always the liability of the driver but as the identity of the driver is unknown then they can attempt to transfer liability to the keeper by adhering to the requirements of schedule 4 of the Protection of Freedoms Act 2012. They haven't met that at all in the parking charge notice so the can't transfer liability.
It's easier if the principal in the matter tells then to cancel. Otherwise it's and appeal to tell them that they can't hold the keeper liable. You probably gone past the date that they will accept an appeal but it is worth a try. Post up if you are successful or not in getting written confirmation of the cancel request. |

Quick update.
Managed to obtain written confirmation that the concierge who stated that the permit was indeed issued for the duration of the stay on the day and that they will take care of the ticket. They asked for 4-5 days to follow up with Parking Awareness, so will check back with them then. Parking Awareness also sent a Final Notice, which you can see here: https://imgur.com/Z1BsEMR |

I'd be reporting that letter as well. If you lose, you won't have to pay their legal fees, as they say in that letter. So much for them not wanting to make threats.

Good news. The security officer has confirmed via email that Parking Awareness have cancelled the PCN as of July 2nd 2020.
Will update the thread should any further Parking Awareness correspondence come through, but hopefully that's that. Thank you for the help. |

Go to their website and click 'pay my PCN' enter the details and it will tell you if it's cancelled on their system.
